New Act
30 ILCS 105/5.640 new

Synopsis As Introduced
Creates the Park and Recreational Facility Construction Act. Authorizes the Department of Natural Resources to determine eligibility for and authorizes the Capitol Development Board (CDB) to make grants to park or recreation units for park or recreational facility construction projects. Establishes an application procedure. Requires the Department to establish eligibility standards and priority standards for park or recreational facility construction grants. Requires CDB to establish project standards for park or recreational facility construction grants and to generally supervise park or recreational facility construction projects. Requires a park or recreation unit to submit the construction project or its financing to a referendum if required by law. Provides that the Chicago Park District may use park or recreational facility construction grants for payment of debt service or a lease. Provides that park or recreation units eligible for but not awarded grants in a fiscal year shall continue to be considered in the next fiscal year. Authorizes CDB and the Department to promulgate rules concerning park or recreational facility construction grants. Requires the Department and CDB to file with the General Assembly a comprehensive report of the capital needs of all park or recreation units in this State before January 1, 2006 and every 2 years thereafter. Amends the State Finance Act to create the Park and Recreational Facility Construction Fund.

 Fiscal Note (Capital Development Board)
The capital cost cannot be determined until a study of the type called for in House Bill 3760 is completed.

Fiscal Note (Department of Natural Resources)
It is difficult to determine the fiscal impact on the agency based on the information contained in House Bill 3760. A lot will depend on the size and duration of the program. If the program is a permanent annual program and of any size, the Department will need additional resources to administer its portion of the program. In the Department's current grant administration division there are 7 grant administrators. These grant administrators manage, on average, $24.4 million in grants each. The average cost for grant administrators, not including non-personal service lines, is $91,600. This means that it would take 1 grant administrator position at a cost of approximately $92,000 for every $25 million in new grant programs.

State Mandates Fiscal Note (Department of Commerce & Economic Opportunity)
Creates a local government organization and structure mandate for which reimbursement of the increased costs to units of local government is not required under the State Mandates Act.

Home Rule Note (Dept. of Commerce & Economic Opportunity)
Does not pre-empt home rule authority.

House Amendment No. 1
Changes the order of prioritization of needs that the Department must use in determining priority needs concerning park and recreation unit construction projects.

Judicial Note (H-AM 1)(Admin Office of the Illinois Courts)
Based on a review of the bill it has been determined that this legislation would neither increase nor decrease the number of judges needed in the state.

Home Rule Note (H-AM 1)(Dept. of Commerce & Economic Opportunity)

State Debt Impact Note (H-AM 1)(Comm on Gov't Forecasting & Accountability)
Although House Bill 3760, as amended by House Amendment 1, does not change the amount of authorization for general obligation or moral obligation bonds, it creates a grant program administered by the Capital Development Board which may use bond funds to provide grants for park and recreational facility construction projects.

 Fiscal Note (Dept of Corrections)
There is no corrections population or fiscal impact on the Department of Corrections.

 Correctional Note (Dept of Corrections)
There is no corrections population or fiscal impact on the Department of Corrections.

Balanced Budget Note (Gov. Office of Management & Budget)
Fiscal Impact: $600,000 in additional operations to CDB and additional funding to DNR based upon the size of the program. Associated cost: Unknown capital expenditures.

Fiscal Note (H-AM 1) (Capital Development Board)
Would create a program within CDB similar to the School Infrastructure Program. That program requires eight staff at an annual cost of $600,000. The capital cost can not be determined until a study of the type called for in the legislation is completed.

House Amendment No. 2
Replaces everything after the enacting clause with the contents of the bill, as amended by House Amendment No. 1, but makes the following changes. Provides that, of the total amount of park or recreation unit construction project grants awarded statewide, 20% shall be awarded to the Chicago Park District, provided that the Chicago Park District complies with the provisions of the Park and Recreational Facility Construction Act, and 80% shall be awarded to park or recreation units outside of the City of Chicago. Deletes provisions authorizing the Chicago Park District to use any or all of the park or recreation unit construction project grants awarded to it to (i) pay debt service on bonds issued to finance park or recreation unit construction projects or (ii) to make certain lease payments. Makes corresponding changes.
