Synopsis As Introduced
Amends the Pharmacy Practice Act of 1987. Makes a technical change in a Section concerning licensure without examination.

House Amendment No. 2
Deletes reference to:
225 ILCS 85/8
Adds reference to:
225 ILCS 85/24.5 new

Deletes everything after the enacting clause. Amends the Pharmacy Practice Act of 1987. Provides that if a wholesale drug distributor or pharmacy benefit manager has entered into a contract with the State to sell or negotiate the sale of a prescription drug to the State at a particular price, then, upon the request of any pharmacy located in the State, the wholesale drug distributor or pharmacy benefit manager must disclose that price and make that prescription drug available to the pharmacy at that same price during the period that the contract with the State is in effect, regardless of the quantity of the drug purchased by the pharmacy. Effective immediately.

 House Bill 2768, as amended by House Amendment 2, would not impact any public pension fund or retirement system in Illinois.

 Fiscal Note (H-AM 2) Department of Central Management Services)
 The Department of Central Management Services anticipates that the fiscal impact from this bill, although impossible to quantify, would be significant. The requirement of making available to a requesting pharmacy the pricing that a wholesaler or prescription benefit manager negotiates with the State would effectively allow all pharmacies in Illinois to purchase prescription drugs with the buying power of a wholesaler or large prescription benefit manager, severely hindering the ability of such entities to effectively compete in Illinois. Furthermore, this would also result in the State losing the benefit of its size and scale in the procurement of pharmacy benefits. This would act as a disincentive for any vendor to contract with the State, resulting in the State not receiving the best contract for acquisition of prescription benefits.
