| SENATE RESOLUTION
|

| WHEREAS, On May 4, 2000, the Governor of the State of |
3 |
| Illinois issued Executive Order No. 4 that created the |
4 |
| Governor's Commission On Capital Punishment; and
|
5 |
| WHEREAS, The duties of the Commission were: (1) to study |
6 |
| and review the administration of the capital punishment process |
7 |
| in Illinois to determine why that process has failed in the |
8 |
| past, resulting in the imposition of death sentences upon |
9 |
| innocent people; (2) to examine ways of providing safeguards |
10 |
| and making improvements in the way law enforcement and the |
11 |
| criminal justice system carry out their responsibilities in the |
12 |
| death penalty process from investigation through trial, |
13 |
| judicial appeal, and executive review; (3) to consider, among |
14 |
| other things, the ultimate findings and final recommendations |
15 |
| of the House Death Penalty Task Force and the Special Supreme |
16 |
| Court Committee on Capital Cases and determine the effect these |
17 |
| recommendations may have on the capital punishment process; and |
18 |
| (4) to make any recommendations and proposals designed to |
19 |
| further ensure that the application and administration of the |
20 |
| death penalty in Illinois is just, fair, and accurate; and |
21 |
| WHEREAS, In April 2002, the Commission issued its |
22 |
| recommendations; and
|
23 |
| WHEREAS, Recommendation No. 83 was among the Commission's |
24 |
| recommendations and provided that the Illinois Supreme Court |
25 |
| should consider ways to broaden the application of many of the |
26 |
| recommendations made by the Commission to improve the criminal |
27 |
| justice system as a whole; and |
28 |
| WHEREAS, Section 16 of Article VI of the Illinois |
29 |
| Constitution vests general administrative and supervisory |
30 |
| authority over all courts in the Supreme Court of Illinois; and |
