SYNOPSIS AS INTRODUCED:
 
9991 ILCS 5/10002ILCON Art. X, Sec. 2

    Proposes to amend Section 2 of Article X of the Illinois Constitution. Provides that the State Superintendent of Education shall be nominated at the general primary election and elected at the general election to serve a term of 4 years beginning on the second Monday of January following his or her election. Establishes eligibility criteria for the office and ballot placement for the election. Provides for the manner of filling a vacancy in the office of State Superintendent of Education. Requires the State Superintendent of Education (instead of allowing the State Board of Education) to establish goals, determine policies, provide for planning and evaluating education programs, and recommend financing, and requires the State Board of Education to advise the State Superintendent of Education concerning these duties. Provides for the following Schedule: (i) a State Superintendent of Education shall be elected in 2006 and thereafter, (ii) the term of office of the appointed State Superintendent of Education expires when the first elected State Superintendent of Education takes office, and (iii) the Constitutional Amendment otherwise takes effect when the first elected State Superintendent of Education takes office.

3     RESOLVED, BY THE SENATE OF THE NINETY-THIRD GENERAL
4 ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES
5 CONCURRING HEREIN, that there shall be submitted to the
6 electors of the State for adoption or rejection at the general
7 election next occurring at least 6 months after the adoption of
8 this resolution a proposition to amend Section 2 of Article X
9 of the Constitution as follows:

EDUCATION

13 SECTION 2. STATE BOARD OF EDUCATION - STATE SUPERINTENDENT OF
14 EDUCATION CHIEF STATE EDUCATIONAL OFFICER
15     (a) There is created a State Board of Education to be
16 elected or selected on a regional basis. The number of members,
17 their qualifications, terms of office and manner of election or
18 selection shall be provided by law. The Board shall advise the
19 State Superintendent of Education concerning , except as
20 limited by law, may establish goals, determine policies,
21 provide for planning and evaluating education programs, and
22 recommend financing. The Board shall have such other duties and
23 powers as provided by law.
24     (b) A State Superintendent of Education shall be nominated
25 at a general primary election and elected by the electors of
26 the State at the general election every 4 years, beginning in
27 2006. The State Superintendent of Education shall hold office
28 for 4 years beginning on the second Monday of January after his
29 or her election. To be eligible to hold the office of State
30 Superintendent of Education a person must be a United States
31 citizen, at least 25 years old, and a resident of the State for
32 10 years preceding his or her election.

1 Education shall be printed on the ballot directly below the
2 names of the candidates for Secretary of State.
3     Any vacancy in the office of State Superintendent of
4 Education shall be filled in the manner provided in Section 7
5 of Article V.
6     The State Superintendent of Education shall be the chief
7 educational officer of the State. The State Superintendent of
8 Education shall establish goals, determine policies, provide
9 for planning and evaluating education programs, and recommend
10 financing. The State Superintendent of Education shall have
11 such other duties and powers as provided by law. The State
12 Board of Education shall appoint a chief state educational
13 officer.

SCHEDULE
16     A State Superintendent of Education shall be elected in
17 2006 and thereafter. When the State Superintendent of Education
18 initially elected under Section 2 of Article X of the Illinois
19 Constitution takes office, the term of office of the chief
20 state educational officer appointed by the State Board of
21 Education shall expire. This Constitutional Amendment
22 otherwise takes effect when the State Superintendent of
23 Education initially elected under Section 2 of Article X of the
24 Illinois Constitution takes office.
