AMENDMENT TO SENATE JOINT RESOLUTION

CONSTITUTIONAL AMENDMENT 20

3     AMENDMENT NO. ___. Amend Senate Joint Resolution
4 Constitutional Amendment 20 by replacing everything after the
5 title with the following:
 
6     "RESOLVED, BY THE SENATE OF THE NINETY-THIRD GENERAL
7 ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES
8 CONCURRING HEREIN, that there shall be submitted to the
9 electors of the State for adoption or rejection at the general
10 election next occurring at least 6 months after the adoption of
11 this resolution a proposition to amend Section 1 of Article X
12 of the Illinois Constitution as follows:
 
13       (ILCON Art. X, Sec. 1)
14 SECTION 1. GOAL - FREE SCHOOLS
15     (a) A fundamental goal of the People of the State is the
16 educational development of all persons to the limits of their
17 capacities.
18     The State shall provide for an efficient system of high
19 quality public educational institutions and services.
20 Education in public schools through the secondary level shall
21 be free. There may be such other free education as the General
22 Assembly provides by law.
23     The State has the primary responsibility for financing the
24 system of public education.

1     (b) The People of the State of Illinois recognize that
2 excessive reliance on real property taxation for financing the
3 system of public education has impeded the fundamental goal of
4 education. The official policy of the State shall be to reduce
5 taxes on owner-occupied residential real property and to
6 improve education by establishing the Education and Permanent
7 Property Tax Relief Trust Fund in this Article.
8     Beginning on January 1 of the year following adoption of
9 this Constitutional Amendment by the People, a surtax on or
10 measured by income at a rate of 3% shall be levied annually on
11 that portion of the adjusted gross income of individuals that
12 exceeds $250,000. All receipts shall be deposited into the
13 Education and Permanent Property Tax Relief Trust Fund. The
14 corporate rate limitation ratio set forth in subsection (a) of
15 Section 3 of Article IX shall remain in effect and be measured
16 by the non-graduated rate authorized in Section 3 of Article
17 IX. Interest earned on the Education and Permanent Property Tax
18 Relief Trust Fund shall be allocated to the Trust Fund.
19     On July 1 of each year, 50% of the public funds in the
20 Education and Permanent Property Tax Relief Trust Fund shall be
21 distributed in equal amounts to every taxpayer who is an
22 owner-occupier of residential real property in the State and
23 the other 50% of the public funds in the Trust Fund shall be
24 distributed equally on a per student basis to improve education
25 in public schools through the secondary level.
26     The General Assembly shall provide by law for the
27 implementation of the public policy set forth in this
28 subsection (b). Every distribution from the Education and
29 Permanent Property Tax Relief Trust Fund shall include the name
30 of each elected officer of the Executive Branch and the
31 following statement: "Adopted by constitutional amendment by
32 the People of the State of Illinois.
33     Existing State funding for public education shall be not be
34 supplanted, reduced, or adversely impacted by distributions

SCHEDULE
5     This Constitutional Amendment takes effect upon being
6 declared adopted in accordance with Section 7 of the Illinois
7 Constitutional Amendment Act.".
