Amends the Illinois Municipal Code. Creates the Cicero Audit Committee.
Provides that the duties of the Committee shall be to review certain financial
reports
prepared by or on behalf of the Town of Cicero. Requires that, no later than
February 1
of each year, the Committee shall report to the Governor and to the members of
the
General Assembly regarding the financial reporting of the Town of Cicero.
Provides that the
Committee
shall consist of 5 members appointed by the Governor with the advice and
consent of the
Senate and that no more than 2 members of the Committee may be residents of the
Town
of Cicero. Provides that the members of the Committee shall serve without
compensation
but may be reimbursed for their reasonable expenses. Requires the corporate
authorities
of the Town of Cicero to provide any information or documents to the Committee
that the
Committee deems necessary in carrying out its duties. Preempts home rule
powers. Provides that these provisions are repealed on February 15, 2006.
Effective immediately.

| Be it enacted by the People of the State of Illinois, |

| represented in the General Assembly:
|

| Section 5. The Illinois Municipal Code is amended by adding |
5 |
| Section 8-8-9.5
as follows:
|

| (65 ILCS 5/8-8-9.5 new)
|

| Sec. 8-8-9.5. Cicero audit committee. The Cicero
Audit
|
8 |
| Committee is created. The duties of the Committee are to review |
9 |
| the audit
reports
prepared
under this Act and any other |
10 |
| financial reports and documents, including
management
letters, |
11 |
| prepared by or on behalf of the Town of Cicero. No later than
|
12 |
| February 1 of each
year, the Committee shall report to the |
13 |
| Governor and to the members of the
General
Assembly regarding |
14 |
| the financial reporting of the Town of Cicero.

| The Committee shall consist of 5 members appointed by the |
16 |
| Governor with the

| appointments to the Committee must be
made
within 180 days |

| after the effective date of this amendatory Act of the 93rd

| General
Assembly. No more than 2 members of the Committee may |

| Committee shall serve without compensation but may
be
|
22 |
| reimbursed for their reasonable expenses related to their |
23 |
| service on the
Committee.

| The corporate authorities of the Town of Cicero must |

| The Town of Cicero may not regulate its finances in a |
29 |
| manner inconsistent
with
the provisions of this Section. This |

| Section is a limitation under subsection
(i) of Section
6 of |
31 |
| Article VII of the Illinois Constitution on the concurrent |
32 |
| exercise by
home rule units
of powers and functions exercised |
