SYNOPSIS AS INTRODUCED:

    Amends the Department of Human Services Act and the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that beginning January 1, 2005, the rights, powers, duties, and functions of the Department of Human Services concerning diabetes prevention programs are transferred to the Department of Public Health. Effective immediately.

1     AN ACT concerning public health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Human Services Act is amended
5 by changing Sections 10-10 and 10-12 as follows:
 
6     (20 ILCS 1305/10-10)
7     Sec. 10-10. Diabetes prevention; special risk groups.
8 Through December 31, 2004, the The Department, and beginning
9 January 1, 2005, the Department of Public Health under Section
10 2310-374 of the Department of Public Health Powers and Duties
11 Law of the Civil Administrative Code of Illinois, shall include
12 within its public health promotion programs and materials
13 information to be directed toward population groups in Illinois
14 that are to be considered at high risk in relation to diabetes,
15 such as Hispanics, people of African descent, the elderly,
16 obese individuals, persons with high blood sugar content and
17 persons with a family history of diabetes. Such information
18 shall inform high risk groups about the causes and prevention
19 of diabetes, the types of treatment for the disease and how
20 treatment may be obtained.

23     Sec. 10-12. Grants to the American Diabetes Association.
24 Until December 31, 2004, the The Department of Human Services,
25 and beginning January 1, 2005, the Department of Public Health
26 under Section 2310-374 of the Department of Public Health
27 Powers and Duties Law of the Civil Administrative Code of
28 Illinois, shall make grants to the American Diabetes
29 Association for research on diabetes from appropriations to the
30 Department from the American Diabetes Association Fund, a
31 special fund created in the State Treasury.

2     Section 10. The Department of Public Health Powers and
3 Duties Law of the Civil Administrative Code of Illinois is
4 amended by adding Section 2310-374 as follows:
 
5     (20 ILCS 2310/2310-374 new)
6     Sec. 2310-374. Diabetes prevention.
7     (a) Beginning January 1, 2005, the Department must include
8 within its public health promotion programs and materials
9 information to be directed toward population groups in Illinois
10 that are to be considered at high risk in relation to diabetes,
11 such as Hispanics, people of African descent, the elderly,
12 obese individuals, persons with high blood sugar content and
13 persons with a family history of diabetes. This information
14 must inform high risk groups about the causes and prevention of
15 diabetes, the types of treatment for the disease, and how
16 treatment may be obtained.
17     (b) Beginning January 1, 2005, the Department must make
18 grants to the American Diabetes Association for research on
19 diabetes from appropriations to the Department from the
20 American Diabetes Association Fund, a special fund created in
21 the State Treasury.
22     (c) The rights, powers, duties, and functions vested in the
23 Department of Human Services under Sections 10-10 and 10-12 of
24 the Department of Human Services Act are transferred to the
25 Department of Department on January 1, 2005. All books,
26 records, documents, property (real and personal), unexpended
27 appropriations, and pending business pertaining to the rights,
28 powers, duties, and functions transferred to the Department
29 under this Section shall be transferred and delivered to the
30 Department effective January 1, 2005.
 
31     Section 99. Effective date. This Act takes effect upon
32 becoming law.
