1 | AN ACT concerning telecommunications.
| ||||||||||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||||
3 | represented in the General Assembly:
| ||||||||||||||||||||||||||||
4 | Section 5. The Illinois Century Network Act is amended by | ||||||||||||||||||||||||||||
5 | changing Sections 10, 15, and 20 as follows:

| ||||||||||||||||||||||||||||
7 | Sec. 10. Illinois Century Network. The Illinois Century | ||||||||||||||||||||||||||||
8 | Network shall be a
service provider that creates and maintains
| ||||||||||||||||||||||||||||
9 | creating and maintaining
high speed telecommunications | ||||||||||||||||||||||||||||
10 | networks and systems that provide reliable communication
links | ||||||||||||||||||||||||||||
11 | as well as other services to and among Illinois schools, | ||||||||||||||||||||||||||||
12 | institutions of higher education,
libraries, museums, research | ||||||||||||||||||||||||||||
13 | institutions, State agencies, units of local
government, and | ||||||||||||||||||||||||||||
14 | other local entities that provide services to Illinois
| ||||||||||||||||||||||||||||
15 | citizens. The Illinois Century Network shall build on existing | ||||||||||||||||||||||||||||
16 | investments in
networking schools, colleges, and universities, | ||||||||||||||||||||||||||||
17 | avoid duplication of future
efforts, maintain sufficient | ||||||||||||||||||||||||||||
18 | capacity to meet the requirements of the
participating | ||||||||||||||||||||||||||||
19 | institutions, and stay current with rapid developments in
| ||||||||||||||||||||||||||||
20 | technology. The Illinois Century Network shall be capable of | ||||||||||||||||||||||||||||
21 | delivering
state-of-the-art access to education, training, and | ||||||||||||||||||||||||||||
22 | electronic information and
shall provide access to networking | ||||||||||||||||||||||||||||
23 | technologies and other services for all institutions located in
| ||||||||||||||||||||||||||||
24 | even the most remote areas of this State. The Illinois Century | ||||||||||||||||||||||||||||
25 | Network may, as determined by the
Department of Central | ||||||||||||||||||||||||||||
26 | Management Services, sell its excess bandwidth to companies | ||||||||||||||||||||||||||||
27 | that are suppliers to any participating entity or institution | ||||||||||||||||||||||||||||
28 | listed above.

31 | Sec. 15. Management of the Illinois Century Network.

1 | (a) Staffing and contractual services necessary to support | ||||||
2 | the network's activities shall be governed by the Department of | ||||||
3 | Central Management Services.
| ||||||
4 | (b) The Illinois Century Network Steering Committee shall | ||||||
5 | exist to advise the Illinois Century Network on issues | ||||||
6 | associated with the Illinois Century Network, service | ||||||
7 | offerings, and general direction within the scope of the | ||||||
8 | Illinois Century Network's overall mission as set forth in | ||||||
9 | Section 10. The committee shall include: | ||||||
10 | (1) 6 standing members as follows: | ||||||
11 | (i) the Illinois State Library Director or | ||||||
12 | designee; | ||||||
13 | (ii) the Illinois State Museum Director or | ||||||
14 | designee; | ||||||
15 | (iii) the Executive Director of the Board of Higher
| ||||||
16 | Education or designee; | ||||||
17 | (iv) the Community College Board President or | ||||||
18 | designee; | ||||||
19 | (v) the State Board of Education State | ||||||
20 | Superintendent or
designee; and | ||||||
21 | (vi) the Director of Central Management Services | ||||||
22 | or
designee;
| ||||||
23 | (2) up to 7 members who are appointed by the Governor | ||||||
24 | who: | ||||||
25 | (i) shall serve staggered terms up to 3 years as
| ||||||
26 | designated by the Governor; and | ||||||
27 | (ii) shall serve until a successor is appointed and
| ||||||
28 | qualified; and | ||||||
29 | (3) a Chairperson who is appointed by the Governor and | ||||||
30 | who
shall serve a term of 2 years and until a successor is | ||||||
31 | appointed and
qualified. | ||||||
32 | (c) Illinois Century Network Steering Committee members | ||||||
33 | shall serve
without compensation but shall be entitled to | ||||||
34 | reimbursement for
reasonable expenses of travel for members who | ||||||
35 | are required to travel for a distance greater than 20 miles to | ||||||
36 | participate in business of the Illinois Century Network |

Governor; and
| ||||||
26 | (iii) shall serve until a successor is appointed | ||||||
27 | and
qualified; and
| ||||||
28 | (3) a Chairperson who is appointed by the Governor and | ||||||

3 | Sec. 20. Additional duties and powers of the Illinois | ||||||
4 | Century Network
Illinois Century Network Policy Committee . The | ||||||
5 | Illinois Century
Network , as governed by the Department of | ||||||
6 | Central
Management Services,
Policy Committee shall set | ||||||
7 | general policies for the network. The
Committee shall
have the | ||||||
8 | following additional duties and powers:
| ||||||
9 | (1) to purchase, acquire, or receive equipment and | ||||||
10 | agreements or
contracts for services for the benefit of the | ||||||
11 | Illinois Century Network or its
participants;
| ||||||
12 | (2) to sell or convey
equipment or services
desirable | ||||||
13 | for Network operations
to its participants
at reasonable | ||||||
14 | costs incurred in the
acquisition of the equipment or | ||||||
15 | services;
| ||||||
16 | (3) to employ and fix the compensation for employees as | ||||||
17 | it deems
reasonable to achieve the purposes of this Act;
| ||||||
18 | (4) to establish and maintain petty cash funds as | ||||||
19 | provided in
Section 13.3 of the State Finance Act;
| ||||||
20 | (5) to make, amend, and repeal bylaws, rules, | ||||||
21 | regulations, and
resolutions that are consistent with this | ||||||
22 | Act;
| ||||||
23 | (6) to make and execute all contracts and instruments | ||||||
24 | necessary or
convenient to the exercise of its powers;
| ||||||
25 | (7) to exclusively control and manage the Network and | ||||||
26 | all moneys
that are donated, paid, or appropriated for the | ||||||
27 | creation, improvement, and
operation of the Network;
| ||||||
28 | (8) to prepare and submit a budget for the necessary | ||||||
29 | and contingent
operation expenses of the Network;
| ||||||
30 | (9) to accept grants and funds from the federal and | ||||||
31 | state
governments and any federal or state agency and to | ||||||
32 | expend those moneys in
accordance and
in furtherance of the | ||||||
33 | purposes of this Act;
| ||||||
34 | (10) to enter into intergovernmental agreements with | ||||||
35 | other
governmental entities, including but not limited to, |

| |||||||
1 | the Board of
Higher Education, the Illinois Community | ||||||
2 | College Board, the State Board
of Education, the Department | ||||||
3 | of Central Management Services, and local
education | ||||||
4 | agencies, in order to implement and execute the powers and
| ||||||
5 | duties set forth in this Act;
| ||||||
6 | (11) to acquire or procure telecommunications or | ||||||
7 | computer networks
or related services, alone or in | ||||||
8 | cooperation with other governmental
or education entities, | ||||||
9 | as may be of reasonable benefit to the Network or its
| ||||||
10 | participants for the general purposes set forth in this | ||||||
11 | Act; and
| ||||||
12 | (12) to receive assignment of ownership or management | ||||||
13 | rights and the use
of telecommunications equipment and | ||||||
14 | services owned or
leased by the State of Illinois or other | ||||||
15 | entities providing services
to Illinois citizens for use in | ||||||
16 | operation of Network programs and
services.

18 | Section 99. Effective date. This Act takes effect upon | ||||||
19 | becoming law.
