Amends the Illinois Public Aid Code. Requires the Department of Human Services to apply to the U.S. Department of Agriculture for a waiver under the food stamp program to prohibit the use of food stamps to purchase foods of minimal nutritional value as defined by the U.S. Department of Agriculture's Food and Nutrition Service. Effective immediately.

| AN ACT concerning public aid.

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Public Aid Code is amended by |
5 |
| adding Section 12-4.4a as follows: |
6 |
| (305 ILCS 5/12-4.4a new) |
7 |
| Sec. 12-4.4a. Food stamp program; foods of minimal |
8 |
| nutritional value; waiver. Promptly after the effective date of |
9 |
| this amendatory Act of the 93rd General Assembly, the |
10 |
| Department of Human Services shall apply to the United States |
11 |
| Department of Agriculture for any necessary waiver of federal |
12 |
| law and regulations to allow the Department of Human Services, |
13 |
| in operating the food stamp program in Illinois, to prohibit |
14 |
| the use of food stamps to purchase foods of minimal nutritional |
15 |
| value as defined by the United States Department of |
16 |
| Agriculture's Food and Nutrition Service in 7 CFR Part 210.

| Section 99. Effective date. This Act takes effect upon |
18 |
| becoming law.
