    Amends the Illinois Diseased Animals Act. Provides that the definition of "animals" includes only those wild animals in captivity that are intended for livestock production. Provides that any person who organizes a livestock swap meet within the State must provide the Department of Agriculture with information regarding the meet and must maintain records detailing the kinds of animals at the meet and the transfer of any animals at the meet. Provides that organizers must maintain the records for at least one year after each swap meet.

1     AN ACT concerning animals.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Diseased Animals Act is amended by
5 changing Section 1 and by adding Section 24.1 as follows:
 
6     (510 ILCS 50/1)  (from Ch. 8, par. 168)
7     Sec. 1. For the purposes of this Act:
8     "Department" means the Department of Agriculture of the
9 State of Illinois.
10     "Director" means the Director of the Illinois Department of
11 Agriculture, or his duly appointed representative.
12     "Contagious or infectious disease" means a specific
13 disease designated by the Department as contagious or
14 infectious under rules pertaining to this Act.
15     "Reportable disease" means a specific disease designated
16 by the Department as reportable under rules pertaining to this
17 Act.
18     "Animals" means domestic animals, poultry, and wild
19 animals in captivity that are intended for livestock
20 production.
21     "Exposed to" means for an animal to come in contact with
22 another animal or an environment that is capable of
23 transmitting a contagious, infectious, or reportable disease.
24 An animal will no longer be considered as "exposed to" when it
25 is beyond the standard incubation time for the disease and the
26 animal has been tested negative for the specific disease or
27 there is no evidence that the animal is contagious, except for
28 animals exposed to Johne's disease. Animals originating from a
29 herd where Johne's disease has been diagnosed will be
30 considered no longer "exposed to" with a negative test. The
31 negative test must have been conducted within 30 days prior to
32 the sale or movement.

3     Sec. 24.1. Swap meets. Any organizer of a livestock swap
4 meet held within the State must provide the Department with
5 information regarding the swap meet at least 30 days prior to
6 the date on which the swap meet will be held. For each
7 livestock swap meet that he or she organizes, an organizer must
8 maintain records for at least one year after the date on which
9 the swap meet is held. The records must include information on
10 each kind of animal present at the swap meet and information on
11 any transfer of animals that takes place during the swap meet.
 
12     Section 99. Effective date. This Act takes effect upon
13 becoming law.
