1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Consortium for Educational
5 Opportunity Act is amended by changing the title of the Act and
6 Sections 1, 2, 3, 4, 6, 7, 8, 9, 10, and 11 and by adding
7 Section 11.5 as follows:

13     Sec. 1. Short Title. This Act shall be known and may be
14 cited as the Diversifying Higher Education Faculty in Illinois
15 Illinois Consortium for Educational Opportunity Act.

18     Sec. 2. Definitions. As used in this Act, unless the
19 context otherwise requires:
20     (a) "Board" means the Board of Higher Education.
21     (b) "Institution of higher education" means a publicly or
22 privately operated educational institution located within
23 Illinois:  (1) which offers instruction leading toward or
24 prerequisite to an academic or professional degree beyond the
25 baccalaureate degree, excluding theological schools, and (2)
26 which requires that in order to obtain such degree the student
27 satisfactorily completes appropriate courses of class,
28 laboratory or research study in residence under a faculty whose
29 members hold appropriate academic degrees, and (3) which meets
30 the standards of approval established by the Board of Higher

1 Education.
2     (c) "Consortium Board" means the representatives of the
3 institutions of higher education participating in the
4 Consortium established under this Act.
5     "DFI" (d) "ICEOP" means the Diversifying Higher Education
6 Faculty in Illinois Program Illinois Consortium for
7 Educational Opportunity program of financial assistance to
8 minorities who are traditionally underrepresented as
9 participants in postsecondary education. The program shall
10 assist them in pursuing a graduate or professional degree and
11 shall also assist program graduates to find employment at an
12 Illinois institution of higher education, including a
13 community college, in a faculty or staff position.
14     "Program Board" means the entity created to administer the
15 grant program authorized by this Act.
16     "Qualified institution of higher education" means a
17 qualifying publicly or privately operated educational
18 institution located within Illinois (i) that offers
19 instruction leading toward or prerequisite to an academic or
20 professional degree beyond the baccalaureate degree, excluding
21 theological schools, and (ii) that is authorized to operate in
22 the State of Illinois.
23     (e) "Racial minority" means a person who is a citizen of
24 the United States or a lawful permanent resident alien of the
25 United States and who is:
26         (1) Black (a person having origins in any of the black
27 racial groups in Africa);
28         (2) Hispanic (a person of Spanish or Portuguese culture
29 with origins in Mexico, South or Central America, or the
30 Caribbean Islands, regardless of race);
31         (3) Asian American (a person having origins in any of
32 the original peoples of the Far East, Southeast Asia, the
33 Indian Subcontinent or the Pacific Islands); or
34         (4) American Indian or Alaskan Native (a person having
35 origins in any of the original peoples of North America).

2     Sec. 3. Composition of the Program Consortium Board. The
3 Program Board shall be comprised of 21 members and shall be
4 appointed by the Board of Higher Education. Persons appointed
5 to the Program Board shall include, but need not be limited to,
6 individuals who are in leadership positions in institutions of
7 higher education, including community colleges. Illinois
8 institutions that grant doctoral degrees must have
9 representation on the Program Board. Consortium Board shall
10 include one representative from each of the institutions of
11 higher education participating in the Consortium.
12     The method of selection shall be determined by each
13 institution of higher education.
14     The Board shall assure, by additional appointments to the
15 Consortium Board, if necessary, that racial minorities who are
16 traditionally underrepresented in postsecondary education
17 programs and activities are members of the Program Consortium
18 Board.

21     Sec. 4. Responsibilities of the Program Consortium Board.
22 The Program Consortium Board shall be responsible for:
23         (a) Establishing policy for administration of the DFI
24 ICEOP grant program authorized under this Act, including
25 criteria to promote placement of grant recipients.
26         (b) Reviewing and approving applications for
27 participation in the DFI ICEOP grant program.
28         (c) Establishing subcommittees or panels as necessary
29 to review applications and promote student placement.
30         (d) Reporting annually to the Board on program outcomes
31 and results, including lists of new and continuing
32 scholarship award recipients by institution, level, and
33 field of study; lists of recipients retained in the program
34 from the previous year; lists of placements of most recent

1 program graduates; a description of institutional efforts
2 to place program graduates; and a description of policy and
3 administrative actions designed to increase placement of
4 grant recipients.

7     Sec. 6. DFI ICEOP grants. A program of financial assistance
8 is established to implement the policy of encouraging minority
9 students to enroll and complete academic programs at the
10 postbaccalaureate level and to enhance the diversity of faculty
11 and staff of Illinois institutions of higher education. The
12 Board of Higher Education shall provide administrative
13 assistance for the Program Consortium Board and shall
14 distribute funds appropriated by the General Assembly for this
15 purpose in accordance with decisions made by the Program
16 Consortium Board.

19     Sec. 7. Eligibility for DFI ICEOP grants. An individual is
20 eligible for an award under the provisions of this Act when the
21 Program Consortium Board finds:
22         (a) That the individual is a resident of this State and
23 a citizen or lawful permanent resident alien of the United
24 States;
25         (b) That the individual is a member of a racial
26 minority as defined under the terms of this Act;
27         (c) That the individual has earned any educational
28 diploma at an institution of education located in this
29 State, or is a resident of the State for no less than three
30 years prior to applying for the grant, and the individual
31 must hold a baccalaureate degree from an institution of
32 higher learning;
33         (d) That the individual's financial resources are such
34 that, in the absence of a DFI an ICEOP grant, the

1 individual will be prevented from pursuing a graduate or
2 professional degree at a qualified institution of higher
3 education of his or her choice;
4         (e) That the individual has above average academic
5 ability to pursue a graduate or professional degree; and
6         (f) That the individual meets other qualifications
7 which shall be established by the Program Consortium Board.
8     Grant funds shall be awarded only to those persons pursuing
9 a graduate or professional degree program at a qualified
10 institution of higher education.
11     The Consortium Board shall by rule promulgate, pursuant to
12 the Illinois Administrative Procedure Act, precise standards
13 to be used by the Program Board to determine whether a program
14 applicant has above average academic ability to pursue a
15 graduate or professional degree.

18     Sec. 8. Application. The Program Consortium Board shall
19 design the application for the DFI ICEOP award and determine
20 the timetable for submission of the application.

23     Sec. 9. Terms of award. After a person has been accepted
24 into the DFI ICEOP, the individual shall be eligible for an
25 annual award which may shall be renewable for up to an
26 additional 3 years provided that he or she makes satisfactory
27 progress toward completing his or her degree. The Program
28 Consortium Board shall determine the award amount annually.

31     Sec. 10. Conditions of award. Conditions for acceptance of
32 a DFI an ICEOP award are that the recipient shall agree to: (1)
33 accept a teaching or nonteaching full-time appointment at an

1 Illinois institution of higher education; or (2) accept a
2 position at one of the higher education governing boards for
3 the period equal to the number of years that he or she was a
4 participant in the ICEOP; or (3) accept a position as an
5 employee of this State in an administrative,
6 educational-related education related position for the period
7 equal to the number of years that he or she was a participant
8 in the DFI ICEOP.

11     Sec. 11. Penalty for failure to fulfill the conditions of a
12 DFI an ICEOP award. If the obligation of the award is not met,
13 repayment of the funds awarded may be required according to
14 procedures rules developed by the Program Consortium Board.

17     Sec. 11.5. Continuing participants. Program participants
18 admitted under the provisions of the former Illinois Minority
19 Graduate Incentive Program/Illinois Consortium for Educational
20 Opportunity Program prior to January 1, 2004 shall be governed
21 by the statutory provisions and rules governing the program at
22 the time of their admission.

24     Section 10. The Illinois Consortium for Educational
25 Opportunity Act is amended by repealing Section 5.
 
26     Section 99. Effective date. This Act takes effect July 1,
27 2004.
