Amends the Illinois Public Aid Code. Provides that on and after July 1, 2005,
the
Department of Public Aid shall reimburse providers of home health services
under the
Medicaid program at the same rates at which the federal government reimburses
providers of those services under the Medicare program, using the Low
Utilization
Payment Adjustment (LUPA) national-average rate structure. Requires that the
Department adjust those rates annually to reflect changes in the LUPA
national-average
rate structure. Effective immediately.

| Be it enacted by the People of the State of Illinois, |

| represented in the General Assembly:
|

| Section 5. The Illinois Public Aid Code is amended by |
5 |
| adding Section 5-5.25 as follows:
|

| (305 ILCS 5/5-5.25 new)
|

| Sec. 5-5.25. Rates for home health services. On and after |
8 |
| July 1, 2005,
the
Department of Public Aid shall reimburse |
9 |
| providers of home health services
under this
Article at the |
10 |
| same rates at which the federal government reimburses providers
|
11 |
| of those
services under the Medicare program, using the Low |
12 |
| Utilization Payment
Adjustment
(LUPA) national-average rate |
13 |
| structure. The Department shall adjust those rates
annually
to |
14 |
| reflect changes in the LUPA national-average rate structure.

| Section 99. Effective date. This Act takes effect upon |

| becoming law.
