Amends the Illinois Vehicle Code. Provides that an off-highway vehicle is a motor-driven recreational vehicle capable of cross-country travel without benefit of a road or trail. Provides that all-terrain vehicles and off-highway motorcycles are off-highway vehicles. Provides that snowmobiles, watercraft, aircraft, and several other specified motor vehicles are not off-highway vehicles. Effective immediately.

| AN ACT concerning vehicles.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Vehicle Code is amended by adding |
5 |
| Section 1-153.2 as follows: |
6 |
| (625 ILCS 5/1-153.2 new)
|

| Sec. 1-153.2. Off-highway vehicle. A motor-driven |
8 |
| recreational vehicle capable of cross-country travel on |
9 |
| natural terrain without benefit of a road or trail, including |
10 |
| an all-terrain vehicle and off-highway motorcycle. Not |
11 |
| included under this Section are: a snowmobile; a motorcycle; a |
12 |
| watercraft; a farm vehicle being used for farming; a vehicle |
13 |
| used for military, fire, emergency, or law enforcement |
14 |
| purposes; a construction or logging vehicle used in the |
15 |
| performance of its common function; a motor vehicle owned by or |
16 |
| operated under contract with a utility, whether publicly or |
17 |
| privately owned, when used for work on utilities; a commercial |
18 |
| vehicle being used for its intended purpose; snow-grooming |
19 |
| equipment when used for its intended purpose; or an aircraft.

| Section 99. Effective date. This Act takes effect upon |
21 |
| becoming law.
