AMENDMENT TO SENATE BILL 2806

2     AMENDMENT NO. ______. Amend Senate Bill 2806 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Consumer Fraud and Deceptive Business
5 Practices Act is amended by adding Section 2QQ as follows:
 
6     (815 ILCS 505/2QQ new)
7     Sec. 2QQ. Public Utilities Act; elderly persons or disabled
8 persons; penalties. It is an unlawful practice within the
9 meaning of this Act to commit a violation punishable under
10 Section 5-202 of the Public Utilities Act that results in an
11 actual injury or loss to an elderly person or disabled person.
12 A civil penalty of $25,000 may be imposed for each violation of
13 this Section and shall be paid into the Community Senior
14 Services and Resources Fund.
15     For the purposes of this Section:
16     "Elderly person" means a person 60 years of age or older.
17     "Disabled person" has the meaning ascribed to "person with
18 a disability" in Section 16-1.3 of the Criminal Code of 1961.
 
19     Section 99. Effective date. This Act takes effect upon
20 becoming law.".
