SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-5.12b new

    Amends the Illinois Public Aid Code. With respect to the Medicaid program, directs the Department of Public Aid to establish a Prescription Drug Therapeutics Committee to review and either approve or reject the Department's prescription drug policies and management practices.

1     AN ACT concerning pubic aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Public Aid Code is amended by
5 adding Section 5-5.12b as follows:
 
6     (305 ILCS 5/5-5.12b new)
7     Sec. 5-5.12b. Prescription Drug Therapeutics Committee.
8     (a) The Department of Public Aid shall establish a
9 Prescription Drug Therapeutics Committee ("the Committee") to
10 review and either approve or reject the Department's
11 prescription drug policies and management practices.
12     (b) The Committee shall be composed of the following 11
13 members:
14         (1) Five physicians licensed to practice medicine in
15     all of its branches in Illinois, including the following:
16             (A) one physician with expertise in the area of
17         family practice;
18             (B) one physician with expertise in the area of
19         pediatrics;
20             (C) one physician with expertise in the area of
21         geriatrics;
22             (D) one physician with expertise in the area of
23         psychiatric medicine; and
24             (E) one physician with expertise in the area of
25         internal medicine and who specializes in the treatment
26         of diabetes.
27         At least 3 of the physicians must have at least 3 years
28     of recent experience in prescription drug formulary
29     management, including therapeutic category review.
30         (2) Two pharmacists who are licensed to practice
31     pharmacy in the State of Illinois and who have a doctor of
32     pharmacy degree or equivalent degree.

1         (3) Two representatives of medical assistance
2     recipients who advocate on behalf of recipients for
3     improved services.
4         (4) Two medical assistance recipients who have had
5     experience with prescription drug policies of the Illinois
6     Department of Public Aid.
7     Committee members shall be appointed for terms of 3 years.
8     A member may be reappointed to the Committee upon completion of
9     the member's term.
10     The Committee members shall select a chair of the Committee
11     from among the members.
12     (c) A member of the Committee may not be employed by or
13     contract with the State of Illinois, a pharmaceutical
14     manufacturer or labeler, or a pharmacy benefits management
15     organization. A member of the Committee may, however, contract
16     with the State under a medical assistance provider agreement
17     for the sole purpose of delivering services to medical
18     assistance recipients.
19     (d) The Committee shall meet at least quarterly and shall
20     also meet on the call of the chair of the Committee. A quorum
21     of the committee consists of 7 members. The affirmative votes
22     of a majority of a quorum of the Committee are required for the
23     Committee to take action on any measure.
24     (e) The Department of Public Aid shall reimburse Committee
25     members for their reasonable expenses actually incurred in
26     performing their duties and shall provide staff support to the
27     Committee at the request of the Committee chair.
28     (f) A meeting of the Committee is a meeting of a public
29     body for purposes of the Open Meetings Act.
30     (g) The Department of Public Aid shall adopt rules to
31     implement this Section.
