Amends the Illinois Groundwater Protection Act. Requires the Department of Natural Resources to develop a program to require and issue permits for high-capacity wells and community water supply systems. Sets forth requirements for the program. Requires the Department to adopt rules to implement the program no later than December 31, 2005. Effective immediately.

| AN ACT concerning groundwater protection.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Groundwater Protection Act is |
5 |
| amended by adding Section 7.5 as follows: |
6 |
| (415 ILCS 55/7.5 new) |

| Sec. 7.5. Permit program for high-capacity wells and |
8 |
| community water supply systems. |

| (a) The Department, with the advice of the Interagency |
10 |
| Coordinating Committee on Groundwater and of the Groundwater |
11 |
| Advisory Council, must develop a program to require and issue |
12 |
| permits for high-capacity wells and community water supply |
13 |
| systems. For purposes of this Section, "high-capacity well" |
14 |
| means: (i) a well that withdraws 70 gallons per minute, 100,000 |
15 |
| gallons per day, or 3,000,000 gallons per month; or (ii) a well |
16 |
| with a casing diameter of 6 or more inches. "Community water |
17 |
| supply system" has the definition set forth in Section 9 of |
18 |
| this Act. |

| (b) In developing the program, the Department must comply |
20 |
| with all of the following: |
21 |
| (1) The application for a permit must require the |
22 |
| applicant to demonstrate that the amount water to be |
23 |
| withdrawn will not be detrimental to the aquifer, |
24 |
| environment, or existing wells. |
25 |
| (2) The Department must recognize and address the |
26 |
| diverse water needs of residents in the different regions |
27 |
| of the State. Addressing this diversity may include |
28 |
| establishing groundwater management areas where permit |
29 |
| requirements may vary. |
30 |
| (3) In developing rules for the program, the Department |
31 |
| must consider circumstances justifying permit exemptions. |
