093_SB2104 LRB093 13096 DRH 18345 b 1 AN ACT in relation to vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Vehicle Code is amended by 5 changing Section 1-145.001 and adding Section 11-1403.5 as 6 follows: 7 (625 ILCS 5/1-145.001) (from Ch. 95 1/2, par. 1-148) 8 Sec. 1-145.001. Motor driven cycle. Every motorcycle and 9 every motor scooter with less than 150 cubic centimeter 10 piston displacement including motorized pedalcycles, but not 11 including motorized scooters as defined in Section 11-1403.5. 12 (Source: P.A. 90-89, eff. 1-1-98.) 13 (625 ILCS 5/11-1403.5 new) 14 Sec. 11-1403.5. Operation of motorized scooters on 15 streets, roads, highways, and sidewalks. 16 (a) As used in this Section, "motorized scooter" means a 17 device upon which a person may ride consisting of a footboard 18 between 2 end wheels, controlled by an upright steering 19 handle attached to the front wheel, powered by a motor having 20 a maximum piston displacement of less than 25 cubic 21 centimeters or an electric driven motor, and capable of a 22 maximum speed of no more than 25 miles per hour on a flat 23 surface. 24 (b) Except as otherwise provided in this Section, it is 25 unlawful for any person to drive or operate any motorized 26 scooter upon any street, highway, roadway, or sidewalk in 27 this State. 28 (c) A municipality, township, county, or other unit of 29 local government may authorize, by ordinance or resolution, 30 the operation of motorized scooters on roadways and sidewalks -2- LRB093 13096 DRH 18345 b 1 under their respective jurisdictions. The Department may 2 authorize the operation of motorized scooters on the roadways 3 and under its jurisdiction. 4 Before permitting the operation of motorised scooters on 5 its roadway or sidewalk, a municipality, township, county, or 6 other unit of local government, or the Department with regard 7 to a roadway, must consider the volume, speed, and character 8 of vehicular traffic on the roadway or the volume of 9 pedestrian traffic on the sidewalk and determine whether 10 motorized scooters may safely travel on the roadway or 11 sidewalk. Upon determining that motorized scooters may 12 safely operate on a roadway or sidewalk, and upon the 13 adoption of an ordinance or resolution by a municipality, 14 township, county, or other unit of local government, or upon 15 authorization by the Department with regard to a roadway, 16 appropriate signs must be posted. 17 If a roadway or sidewalk is under the jurisdiction of 18 more than one unit of government, motorized scooters may not 19 be operated on the roadway or sidewalk unless each unit of 20 government agrees and takes action as provided in this 21 subsection (c). 22 (d) A person who operates or is in actual physical 23 control of a motorized scooter on a roadway while under the 24 influence of alcohol, drugs, intoxicating compounds, or a 25 combination of them is subject to Sections 11-500 through 26 11-502. 27 Section 99. Effective date. This Act takes effect upon 28 becoming law.
