 1        AN ACT in relation to alcohol.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The Liquor Control Act of 1934 is amended by
 5    adding Section 6-32 as follows:

 6        (235 ILCS 5/6-32 new)
 7        Sec. 6-32. Safety provisions.
 8        (a)  A retailers on premise consumption licensee may  not
 9    permit  the use of any pyrotechnic device within its licensed
10    premises without the  prior  authorization  of  the  Illinois
11    State  Fire  Marshal.   A  retailers  on  premise consumption
12    licensee, or any agent or employee of that licensee, may  not
13    use  mace,  pepper  spray,  or  any  other toxic air-released
14    compound within its licensed  premises.   Violation  of  this
15    subsection  (a) by any licensee or any employee or agent of a
16    licensee is a Class 4 felony.
17        (b)  No person may impede any person who is attempting to
18    exit the premises  of  a  retailers  on  premise  consumption
19    licensee due to an emergency that constitutes a threat to the
20    health  or  safety  of  persons within the licensed premises.
21    For the purpose of this Section, the term  "impede  a  person
22    who  is  attempting  to exit" includes physically restraining
23    the person or blocking or locking an exit while the  licensed
24    premises is open to the public.  Violation of this subsection
25    (b) is a Class 4 felony.
26        (c)  A  retailers on premise consumption licensee with an
27    authorized capacity of at least  250  persons  must  place  a
28    panic bar on each exit of its licensed premises.  A retailers
29    on  premise  consumption licensee with an authorized capacity
30    of at least 500  persons  that  conducts  live  entertainment
31    within its licensed premises must, before the commencement of

 1    the  live  entertainment, make an announcement to the patrons
 2    of the licensed premises that informs those  patrons  of  the
 3    locations  of  all  exits  and  fire  escapes at the licensed
 4    premises.
 5        (d)  Upon  the  request  of  a   retailers   on   premise
 6    consumption  licensee,  local fire department personnel shall
 7    review fire safety practices with the licensee and the agents
 8    and employees of the licensee.

 9        Section 99.  Effective date.  This Act takes effect  upon
10    becoming law.
