The State Finance Act is amended by adding 5 Section 5.595 as follows: 6 (30 ILCS 105/5.595 new) 7 Sec. 5.595. The Universal Charitable Organization Fund. 8 Section 10. The Illinois Vehicle Code is amended by 9 changing Section 3-633 as follows: 10 (625 ILCS 5/3-633) 11 Sec. 3-633. Universal Charitable Organization license 12 plate. 13 (a) In addition to any other special license plate, the 14 Secretary, upon receipt of all applicable fees and 15 applications made in the form prescribed by the Secretary of 16 State, may issue Universal Charitable Organization license 17 plates to residents of Illinois on behalf of organizations 18 that meet the requirements of Title 26, Section 501(c)(3) of 19 the United States Code formed for any bona fide charitable, 20 benevolent, philanthropic, or patriotic purpose. The 21 Secretary of State may prescribe rules establishing 22 additional eligibility criteria for charitable organizations 23 under this Section. The special Universal Charitable 24 Organization plate issued under this Section shall be affixed 25 only to passenger vehicles of the first division and motor 26 vehicles of the second division weighing not more than 8,000 27 pounds. Plates issued under this Section shall expire 28 according to the staggered multi-year procedure established 29 by Section 3-414.1 of this Code. -2- LRB093 10509 DRH 10763 b 1 (b) The design, color, and format of the plates shall be 2 wholly within the discretion of the Secretary of State. The 3 plates are not required to designate "Land of Lincoln", as 4 prescribed in subsection (b) of Section 3-412 of this Code. 5 Charitable organizations deemed eligible by the Secretary of 6 State shall design charitable decals to be affixed on plates 7 issued under this Section. The Secretary may prescribe rules 8 governing the requirements and approval of charitable decals. 9 (c) (Blank).An applicant shall be charged a $15 fee for10original issuance in addition to the applicable registration11fee. This additional fee shall be deposited into the12Secretary of State Special License Plate Fund. For each13registration renewal period, a $2 fee, in addition to the14appropriate registration fee, shall be charged and shall be15deposited into the Secretary of State Special License Plate16Fund. Charitable organizations may establish a fee for the17purchase of their charitable decal and shall report by July1831 of each year to the Secretary of State Vehicle Services19Department the sticker fee, the number of charitable decals20sold, the total revenue received from the sale of charitable21decals during the previous fiscal year, and any other22information deemed necessary by the Secretary of State.23 (d) An applicant for the special plate shall be charged 24 a $25 fee for original issuance in addition to the 25 appropriate registration fee. Of this fee, $10 shall be 26 deposited into the Universal Charitable Organization Fund and 27 $15 shall be deposited into the Secretary of State Special 28 License Plate Fund, to be used by the Secretary to help 29 defray the administrative processing costs. For each 30 registration renewal period, a $25 fee, in addition to the 31 appropriate registration fee, shall be charged. Of this fee, 32 $23 shall be deposited into the Universal Charitable 33 Organization Fund and $2 shall be deposited into the 34 Secretary of State Special License Plate Fund. -3- LRB093 10509 DRH 10763 b 1 (e) The Universal Charitable Organization Fund is 2 created as a special fund in the State Treasury. The State 3 Treasurer shall create separate accounts within the Universal 4 Charitable Organization Fund for each charitable organization 5 for which the Secretary has designed and issued decals. 6 Moneys in the Universal Charitable Organization Fund shall be 7 allocated to each account in proportion to the number of 8 decals sold for each charitable organization. All moneys in 9 each separate account within the Universal Charitable 10 Organization Fund shall be distributed, subject to 11 appropriation by the General Assembly and approval by the 12 Secretary, as grants to that charitable organization. 13 (Source: P.A. 89-564, eff. 7-1-97; 90-14, eff. 7-1-97.)
