093_SB1339 LRB093 08208 LCB 08415 b 1 AN ACT concerning clergy. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Code of Civil Procedure is amended by 5 changing Section 8-803 as follows: 6 (735 ILCS 5/8-803) (from Ch. 110, par. 8-803) 7 Sec. 8-803. Clergy. A clergyman or practitioner of any 8 religious denomination accredited by the religious body to 9 which he or she belongs, shall not be compelled to disclose 10 in any court, or to any administrative board or agency, or to 11 any public officer, a confession,oradmission, or 12 communication made to him or her in his or her professional 13 character or as a spiritual advisor in the course of the 14 discipline enjoined by the rules or practices of such 15 religious body or of the religion which he or she professes, 16 nor be compelled to divulge any information which has been 17 obtained by him or her in such professional character or as 18 such spiritual advisor if: 19 (1) the confession, admission, or communication is 20 intended to be confidential; 21 (2) the confidential confession, admission, or 22 communication is made directly to a member of the clergy; 23 and 24 (3) the confidential confession, admission, or 25 communication is such that the clergyman is bound to 26 maintain that confidentiality pursuant to a duty under 27 the canon law, church doctrine, practice, discipline, 28 tenet, custom, or practice of his or her denomination. 29 This Section is subject to the provisions of Section 4 of 30 the Abused and Neglected Child Reporting Act. 31 (Source: P.A. 82-280.)
