1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The School Code is amended by changing
5 Sections 30-9, 30-10, 30-11, 30-12, and 30-16.4 as follows:
6 (105 ILCS 5/30-9) (from Ch. 122, par. 30-9)
7 Sec. 30-9. General Assembly scholarship; conditions of
8 admission; award by competitive examination.
9 (a) The provisions of this subsection (a) are subject to
10 subsection (b). Each member of the General Assembly may
11 nominate annually 2 persons of school age and otherwise
12 eligible, from his district; one shall receive a certificate
13 of scholarship in the University of Illinois and the other
14 shall receive a certificate of scholarship in any other State
15 supported university designated by the member. Any member of
16 the General Assembly in making nominations under this Section
17 may designate that his nominee be granted a 4 year
18 scholarship or may instead designate 2 or 4 nominees for that
19 particular scholarship, each to receive a 2 year or a one
20 year scholarship, respectively. The nominee, if a graduate of
21 a school accredited by the University to which nominated,
22 shall be admitted to the university on the same conditions as
23 to educational qualifications as are other graduates of
24 accredited schools. If the nominee is not a graduate of a
25 school accredited by the university to which nominated, he
26 must, before being entitled to the benefits of the
27 scholarship, pass an examination given by the superintendent
28 of schools of the county where he resides at the time stated
29 in Section 30-7 for the competitive examination. The
30 president of each university shall prescribe the rules
31 governing the examination for scholarship to his university.

1 A member of the General Assembly may award the
2 scholarship by competitive examination conducted under like
3 rules as prescribed in Section 30-7 even though one or more
4 of the applicants are graduates of schools accredited by the
5 university.
6 A member of the General Assembly may delegate to the
7 Illinois Student Assistance Commission the authority to
8 nominate persons for General Assembly scholarships which that
9 member would otherwise be entitled to award, or may direct
10 the Commission to evaluate and make recommendations to the
11 member concerning candidates for such scholarships. In the
12 event a member delegates his nominating authority or directs
13 the Commission to evaluate and make recommendations
14 concerning candidates for General Assembly scholarships, the
15 member shall inform the Commission in writing of the criteria
16 which he wishes the Commission to apply in nominating or
17 recommending candidates. Those criteria may include some or
18 all of the criteria provided in Section 25 of the Higher
19 Education Student Assistance Act. A delegation of authority
20 under this paragraph may be revoked at any time by the
21 member.
22 Failure of a member of the General Assembly to make a
23 nomination in any year shall not cause that scholarship to
24 lapse, but the member may make a nomination for such
25 scholarship at any time thereafter through June 1, 2003;
26 before the expiration of his term, and the person so
27 nominated shall be entitled to the same benefits as holders
28 of other scholarships provided herein. Any such scholarship
29 for which a member has made no nomination on or before June
30 1, 2003 prior to the expiration of the term for which he was
31 elected shall lapse upon the expiration of that term.
32 (b) After June 1, 2003 no person may be nominated to
33 receive any one-year, 2-year, 4-year, or other scholarship or
34 certificate of scholarship under this Section, nor may any

1 such scholarship be awarded under this Section after June 1,
2 2003 unless the person was nominated prior to that date to
3 receive that scholarship.

6 Sec. 30-10. Filing nominations; failure to accept or
7 pass; second nomination.
8 Nominations that are made, under Section 30-9 on or
9 before June 1, 2003 and that show, showing the name and
10 address of the nominee, and the term of the scholarship,
11 whether 4 years, 2 years or one year, must be filed with the
12 State Superintendent of Education if the scholarship is in a
13 university other than the University of Illinois, or with the
14 president of the University of Illinois if the scholarship is
15 in such university, not later than the opening day of the
16 semester or term with which the scholarship is to become
17 effective. The State Superintendent of Education shall
18 forthwith notify the president of the university other than
19 the University of Illinois of such nomination. No valid
20 nomination to any scholarship may be made under Section 30-9
21 after June 1, 2003.
22 If the nominee fails to accept the nomination or, not
23 being a graduate of a school accredited by the university,
24 fails to pass the examination for admission, the president of
25 the university shall at once notify the State Superintendent
26 of Education if the university is other than the University
27 of Illinois. Upon receiving such notification, the State
28 Superintendent of Education shall notify the nominating
29 member, who may, on or before, but not after June 1, 2003,
30 name another person for the scholarship. In the case of a
31 scholarship in the University of Illinois, such notification
32 shall be given by the president thereof to the nominating
33 member. The second nomination must be received by the State

1 Superintendent of Education or president of the University of
2 Illinois, as the case may be, not later than the middle of
3 the semester or term with which the scholarship was to have
4 become effective under the original nomination in order to
5 become effective as of the opening date of such semester or
6 term otherwise it shall not become effective until the
7 beginning of the next semester or term following the making
8 of the second nomination; provided that the second nomination
9 must be made, if at all, on or before June 1, 2003 or the
10 scholarship shall be deemed to have lapsed by operation of
11 law. Upon receiving such notification of a second nomination
12 on or before June 1, 2003, the State Superintendent of
13 Education shall notify the president of the university of
14 such second nomination. If any person nominated after the
15 effective date of this amendatory Act of 1973 to receive a
16 General Assembly scholarship changes his residence to a
17 location outside of the district from which he was nominated,
18 his nominating member may terminate that scholarship at the
19 conclusion of the college year in which he is then enrolled,
20 but after June 1, 2003 no person may be nominated to receive
21 or otherwise be awarded all or any part of the scholarship
22 that is unused or unexpired at the time the scholarship is so
23 terminated. For purposes of this paragraph, a person changes
24 his residence if he registers to vote in a location outside
25 of the district from which he was nominated, but does not
26 change his residence merely by taking off-campus housing or
27 living in a nonuniversity residence.

30 Sec. 30-11. Failure to use scholarship; further
31 nominations. If any nominee under Section 30-9 or 30-10
32 discontinues his course of instruction or fails to use the
33 scholarship, leaving 1, 2, 3, or 4 years thereof unused, the

1 member of the General Assembly may, except as otherwise
2 provided in this Article, nominate some other person eligible
3 under this Article from his district who shall be entitled to
4 the scholarship for the unexpired period thereof; provided
5 that the nomination for the unexpired period of the
6 scholarship must be made, if at all, on or before June 1,
7 2003 or such nomination shall be invalid, and the
8 scholarship and its unexpired period shall be deemed to have
9 lapsed by operation of law. Such appointment to an unexpired
10 scholarship vacated before July 1, 1961, may be made only by
11 the member of the General Assembly who made the original
12 appointment and during the time he is such a member. If a
13 scholarship is vacated on or after July 1, 1961, and the
14 member of the General Assembly who made the original
15 appointment has ceased to be a member, some eligible person
16 may be nominated in the following manner to fill the vacancy:
17 If the original appointment was made by a Senator, such
18 nomination shall be made by the Senator from the same
19 district; if the original appointment was made by a
20 Representative, such nomination shall be made by the
21 Representative from the same district. Every nomination to
22 fill a vacancy must be made on or before June 1, 2003 and
23 accompanied either by a release of the original nominee or if
24 he is dead then an affidavit to that effect by some competent
25 person. The failure of a nominee to register at the
26 university within 20 days after the opening of any semester
27 or term shall be deemed a release by him of the nomination,
28 unless he has been granted a leave of absence in accordance
29 with Section 30-14 or unless his absence is by reason of his
30 entry into the military service of the United States. The
31 university, other than the University of Illinois, shall
32 immediately upon the expiration of 20 days after the
33 beginning of the semester or term notify the State Board of
34 Education as to the status of each scholarship, who shall

1 forthwith notify the nominating member of any nominee's
2 failure to register or, if the nominating member has ceased
3 to be a member of the General Assembly, shall notify the
4 member or members entitled to make the nomination to fill the
5 vacancy. In the case of a scholarship in the University of
6 Illinois, such notification of vacancy shall be made by the
7 president thereof to the nominating member or his successor
8 as above provided. All nominations to unused or unexpired
9 scholarships, if made on or before June 1, 2003, shall be
10 effective as of the opening of the semester or term of the
11 university during which they are made if they are filed with
12 the university during the first half of the semester or term,
13 otherwise they shall not be effective until the opening of
14 the next following semester or term; provided that no
15 nomination to an unused or unexpired scholarship is valid if
16 made after June 1, 2003, and an unused or unexpired
17 scholarship shall be deemed to have lapsed by operation of
18 law unless the nomination to that unused or unexpired
19 scholarship is made on or before June 1, 2003.

22 Sec. 30-12. Failure to begin or discontinuance of course
23 because of military service.
24 Any nominee, under Sections 30-9, 30-10, or 30-11, who
25 fails to begin or discontinues his course of instruction
26 because of his entry into the military service of the United
27 States, leaving all or a portion of the scholarship unused,
28 may, upon completion of such service, use the scholarship or
29 the unused portion thereof, regardless of whether or not the
30 member of the General Assembly who nominated him is then a
31 member; provided that during the nominee's period of military
32 service no other person may be nominated by such member to
33 all or any portion of such unused or unfinished scholarship

1 unless the nomination is accompanied either by a release of
2 the original nominee or if he is dead then an affidavit to
3 that effect by some competent person and unless the
4 nomination is made on or before June 1, 2003.

7 Sec. 30-16.4. Privileges Conferred. The scholarships
8 issued under Sections 30-16.1 through 30-16.6, inclusive, of
9 this Article, may be used at those State supported
10 universities where there are provided Reserve Officer's
11 Training Corps programs of the several Armed Services over a
12 period during which the eligible recipient is eligible for
13 enrollment in the program. The scholarships shall cover
14 exempt the holder from the payment of tuition, or any
15 matriculation, graduation, activity, term or incidental fee,
16 except any portion of a multi-purpose fee which is used for a
17 purpose for which payment exemption is not granted under this
18 Section. Payment Exemption may not be granted for any other
19 fees including book rental, service, laboratory, supply,
20 Union Building, hospital and medical insurance fees and any
21 fees established for the operation and maintenance of
22 buildings, the income of which is pledged to the payment of
23 interest and principal, or bonds issued by the governing
24 board of the universities.
25 Any student who has been or is awarded a scholarship
26 shall be reimbursed by the appropriate university for any
27 fees which he has paid and for which exemption is granted
28 under this Section, if application for such reimbursement is
29 made within 2 months following the school term for which the
30 fees were paid.
31 The holder of a scholarship is subject to all
32 examinations, rules and requirements of the university in
33 which he is enrolled, except as herein directed.

1 The provisions of Sections 30-16.1 through 30-16.6 of
2 this Act do not prohibit the Board of Trustees of the
3 University of Illinois, the Board of Trustees of Southern
4 Illinois University, the Board of Trustees of Chicago State
5 University, the Board of Trustees of Eastern Illinois
6 University, the Board of Trustees of Governors State
7 University, the Board of Trustees of Illinois State
8 University, the Board of Trustees of Northeastern Illinois
9 University, the Board of Trustees of Northern Illinois
10 University, and the Board of Trustees of Western Illinois
11 University from granting other scholarships.

13 Section 10. The Educational Partnership Act is amended
14 by changing Section 5 as follows:

16 Sec. 5. Public institutions of higher education shall,
17 whenever possible, make arrangements for awarding academic
18 credit to students furnishing tutoring services., and In
19 addition each public community college shall provide for
20 appropriate full or partial waiver of its tuition or fees to
21 students furnishing tutoring services.

23 Section 15. The Board of Higher Education Act is amended
24 by changing Section 9.24 as follows:

26 Sec. 9.24. Sports Equity in Intercollegiate Athletics.
27 For the purpose of attaining gender equity in intercollegiate
28 athletics, public community colleges institutions of higher
29 education may grant, in addition to any such amounts
30 previously authorized by the Board, tuition waivers in an

1 amount not to exceed 1% of all tuition income.
2 Intercollegiate athletics, for purposes of this Section,
3 shall include only those sports sanctioned by the National
4 Collegiate Athletic Association and the National Association
5 of Intercollegiate Athletics, but shall not include club
6 sports.
7 Before issuing any such tuition waiver, public community
8 colleges institutions of higher education shall place on file
9 with the Board a plan for achieving gender equity in
10 intercollegiate athletics. The plan shall include, but not
11 be limited to:
12 (1) intercollegiate sports opportunities available
13 to both men and women;
14 (2) activities to be undertaken by the institution
15 to achieve gender equity in intercollegiate athletics;
16 (3) identification of the barriers to achieving and
17 maintaining equitable intercollegiate athletic
18 opportunities for men and women;
19 (4) progress in achieving sports equity in
20 compliance with Title IX of the Education Amendments of
21 1972; and
22 (5) the use of tuition waivers for attaining gender
23 equity in intercollegiate sports.
24 The Board shall report every 3 years to the General
25 Assembly and the Governor, on or before the second Wednesday
26 of April, beginning in 2002, with a description of the plans
27 submitted by each public community college institution of
28 higher education relative to attainment of gender equity in
29 intercollegiate sports. The report shall include financial
30 data on tuition waivers and other intercollegiate athletic
31 expenditures for men and women, the effectiveness of the
32 plans, and the degree of compliance with Title IX of the
33 Higher Education Act of 1965.

1 Section 20. The University of Illinois Act is amended by
2 changing Section 7g as follows:

4 Sec. 7g. Tuition waivers prohibited. The Board of
5 Trustees may not offer either a full or partial tuition
6 waiver to any of the University's students. In addition to
7 any tuition waivers that the Board of Trustees offers that
8 are exempt by statute from any tuition waiver limitation
9 established by the Illinois Board of Higher Education, the
10 Board of Trustees is authorized to waive, for individuals
11 with the requisite athletic, academic, or other abilities,
12 that percentage of its undergraduate tuition that is
13 authorized under the tuition waiver limitation established in
14 regulations promulgated by the Illinois Board of Higher
15 Education. If in any fiscal year the Board of Trustees
16 issues undergraduate tuition waivers to individuals in an
17 aggregate amount exceeding the aggregate tuition waiver
18 amount authorized for that fiscal year under the tuition
19 waiver limitation established by the Illinois Board of Higher
20 Education, the University's budget request for the succeeding
21 fiscal year may be reduced by the Illinois Board of Higher
22 Education by an amount equal to that tuition waiver excess.

24 Section 25. The Southern Illinois University Management
25 Act is amended by changing Section 8g as follows:

29 University's students. In addition to any tuition waivers
30 that the Board of Trustees offers that are exempt by statute
31 from any tuition waiver limitation established by the

1 Illinois Board of Higher Education, the Board of Trustees is
2 authorized to waive, for individuals with the requisite
3 athletic, academic, or other abilities, that percentage of
4 its undergraduate tuition that is authorized under the

6 promulgated by the Illinois Board of Higher Education. If in
7 any fiscal year the Board of Trustees issues undergraduate
8 tuition waivers to individuals in an aggregate amount
9 exceeding the aggregate tuition waiver amount authorized for
10 that fiscal year under the tuition waiver limitation
11 established by the Illinois Board of Higher Education, the
12 University's budget request for the succeeding fiscal year
13 may be reduced by the Illinois Board of Higher Education by
14 an amount equal to that tuition waiver excess.

16 abilities, that percentage of its undergraduate tuition that

7 amount exceeding the aggregate tuition waiver amount
8 authorized for that fiscal year under the tuition waiver

11 fiscal year may be reduced by the Illinois Board of Higher
12 Education by an amount equal to that tuition waiver excess.

14 Section 65. The Higher Education Student Assistance Act
15 is amended by changing Sections 45, 65.15, and 65.40 as
16 follows:

18 Sec. 45. Illinois National Guard grant program.
19 (a) As used in this Section:
20 "State controlled university or community college" means
21 those institutions under the administration of the Chicago
22 State University Board of Trustees, the Eastern Illinois
23 University Board of Trustees, the Governors State University
24 Board of Trustees, the Illinois State University Board of
25 Trustees, the Northeastern Illinois University Board of
26 Trustees, the Northern Illinois University Board of Trustees,
27 the Western Illinois University Board of Trustees, Southern
28 Illinois University Board of Trustees, University of Illinois
29 Board of Trustees, or the Illinois Community College Board.
30 "Tuition and fees" shall not include expenses for any
31 sectarian or denominational instruction, the construction or
32 maintenance of sectarian or denominational facilities, or any

1 other sectarian or denominational purposes or activity.
2 "Fees" means matriculation, graduation, activity, term,
3 or incidental fees. Exemption shall not be granted from any
4 other fees, including book rental, service, laboratory,
5 supply, and union building fees, hospital and medical
6 insurance fees, and any fees established for the operation
7 and maintenance of buildings, the income of which is pledged
8 to the payment of interest and principal on bonds issued by
9 the governing board of any university or community college.
10 (b) Any enlisted person or any company grade officer,
11 including warrant officers, First and Second Lieutenants, and
12 Captains in the Army and Air National Guard, who has served
13 at least one year in the Illinois National Guard and who
14 possesses all necessary entrance requirements shall, upon
15 application and proper proof, be awarded a grant to the
16 State-controlled university or community college of his or
17 her choice, consisting of exemption from tuition and fees for
18 not more than the equivalent of 4 years of full-time
19 enrollment in relation to his or her course of study at that
20 State controlled university or community college while he or
21 she is a member of the Illinois National Guard. If the
22 recipient of any grant awarded under this Section ceases to
23 be a member of the Illinois National Guard while enrolled in
24 a course of study under that grant, the grant shall be
25 terminated as of the date membership in the Illinois National
26 Guard ended, and the recipient shall be permitted to complete
27 the school term in which he or she is then enrolled only upon
28 payment of tuition and other fees allocable to the part of
29 the term then remaining. If the recipient of the grant fails
30 to complete his or her military service obligations or
31 requirements for satisfactory participation, the Department
32 of Military Affairs shall require the recipient to repay the
33 amount of the grant received, prorated according to the
34 fraction of the service obligation not completed, and, if

1 applicable, reasonable collection fees. The Department of
2 Military Affairs may adopt rules relating to its collection
3 activities for repayment of the grant under this Section.
4 Unsatisfactory participation shall be defined by rules
5 adopted by the Department of Military Affairs. Repayments
6 shall be deposited in the National Guard Grant Fund. The
7 National Guard Grant Fund is created as a special fund in the
8 State treasury. All money in the National Guard Grant Fund
9 shall be used, subject to appropriation, by the Department of
10 Military Affairs for the purposes of this Section.
11 A grant awarded under this Section shall be considered an
12 entitlement which the State-controlled university or
13 community college in which the holder is enrolled shall honor
14 without any condition other than the holder's maintenance of
15 minimum grade levels and a satisfactory student loan
16 repayment record pursuant to subsection (c) of Section 20 of
17 this Act.
18 (c) Subject to a separate appropriation for such
19 purposes, the Commission shall may reimburse the
20 State-controlled university or community college for grants
21 authorized by this Section.

24 Sec. 65.15. Special education teacher scholarships.
25 (a) There shall be awarded annually 250 scholarships to
26 persons qualifying as members of either of the following
27 groups:
28 (1) Students who are otherwise qualified to receive
29 a scholarship as provided in subsections (b) and (c) of
30 this Section and who make application to the Commission
31 for such scholarship and agree to take courses that will
32 prepare the student for the teaching of children
33 described in Section 14-1 of the School Code.

1 (2) Persons holding a valid certificate issued
2 under the laws relating to the certification of teachers
3 and who make application to the Commission for such
4 scholarship and agree to take courses that will prepare
5 them for the teaching of children described in Section
6 14-1 of the School Code.
7 Scholarships awarded under this Section shall be issued
8 pursuant to regulations promulgated by the Commission;
9 provided that no rule or regulation promulgated by the State
10 Board of Education prior to the effective date of this
11 amendatory Act of 1993 pursuant to the exercise of any right,
12 power, duty, responsibility or matter of pending business
13 transferred from the State Board of Education to the
14 Commission under this Section shall be affected thereby, and
15 all such rules and regulations shall become the rules and
16 regulations of the Commission until modified or changed by
17 the Commission in accordance with law.
18 For the purposes of this Section scholarships awarded
19 each school year shall be deemed to be issued on July 1 of
20 the year prior to the start of the postsecondary school term
21 and all calculations for use of the scholarship shall be
22 based on such date. Each scholarship shall entitle its
23 holder to payment of exemption from fees as provided in
24 subsection (a) of Section 65.40 while enrolled in a special
25 education program of teacher education, for a period of not
26 more than 4 calendar years and shall be available for use at
27 any time during such period of study except as provided in
28 subsection (b) of Section 65.40.
29 Scholarships issued to holders of a valid certificate
30 issued under the laws relating to the certification of
31 teachers as provided in paragraph (2) of this subsection may
32 also entitle the holder thereof to a program of teacher
33 education that will prepare the student for the teaching of
34 children described in Section 14-1 of the School Code at the

1 graduate level.
2 (b) Each year, the principal, or his or her designee,
3 of each recognized public, private and parochial high school
4 maintaining the twelfth grade shall certify to the Commission
5 the names and addresses of students who are completing an
6 application with the intent to prepare to teach in any
7 recognized public, private, or parochial school of Illinois
8 and ranked scholastically in the upper one-half of their
9 graduating class or, for those not yet graduated, whose
10 scholastic rank in the 4-year high school course of study at
11 the end of the sixth semester is in the upper one-half of
12 their class.
13 (c) Each holder of a scholarship must furnish proof to
14 the Commission, in such form and at such intervals as the
15 Commission prescribes, of the holder's continued enrollment
16 in a teacher education program qualifying the holder for the
17 scholarship. Any holder of a scholarship who fails to
18 register in a special education program of teacher education
19 at the university within 10 days after the commencement of
20 the term, quarter or semester immediately following the
21 receipt of the scholarship or who, having registered,
22 withdraws from the university or transfers out of teacher
23 education, shall thereupon forfeit the right to use it and it
24 may be granted to the person having the next highest rank as
25 shown on the list held by the Commission. If the person
26 having the next highest rank, within 10 days after
27 notification thereof by the Commission, fails to register at
28 any such university in a special education program of teacher
29 education, or who, having registered, withdraws from the
30 university or transfers out of teacher education, the
31 scholarship may then be granted to the person shown on the
32 list as having the rank next below such person.
33 (d) Any person who has accepted a scholarship under the
34 preceding subsections of this Section must, within one year

1 after graduation from or termination of enrollment in a
2 teacher education program, begin teaching at a nonprofit
3 Illinois public, private, or parochial preschool or
4 elementary or secondary school for a period of at least 2 of
5 the 5 years immediately following that graduation or
6 termination, excluding, however, from the computation of that
7 5 year period (i) any time up to 3 years spent in the
8 military service, whether such service occurs before or after
9 the person graduates; (ii) any time that person is enrolled
10 full-time in an academic program related to the field of
11 teaching leading to a graduate or postgraduate degree; (iii)
12 the time that person is temporarily totally disabled for a
13 period of time not to exceed 3 years, as established by the
14 sworn affidavit of a qualified physician; (iv) the time that
15 person is seeking and unable to find full time employment as
16 a teacher at an Illinois public, private, or parochial
17 school; or (v) the time that person is taking additional
18 courses, on at least a half-time basis, needed to obtain
19 certification as a teacher in Illinois.
20 A person who has accepted a scholarship under the
21 preceding subsections of this Section and who has been unable
22 to fulfill the teaching requirements of this Section may
23 receive a deferment from the obligation of repayment under
24 this subsection (d) under guidelines established by the
25 Commission; provided that no guideline established for any
26 such purpose by the State Board of Education prior to the
27 effective date of this amendatory Act of 1993 shall be
28 affected by the transfer to the Commission of the
29 responsibility for administering and implementing the
30 provisions of this Section, and all guidelines so established
31 shall become the guidelines of the Commission until modified
32 or changed by the Commission.
33 Any such person who fails to fulfill this teaching
34 requirement shall pay to the Commission the amount of tuition

1 waived by virtue of his or her acceptance of the scholarship,
2 together with interest at 5% per year on that amount.
3 However, this obligation to repay the amount of the
4 scholarship tuition waived plus interest does not apply when
5 the failure to fulfill the teaching requirement results from
6 the death or adjudication as a person under legal disability
7 of the person holding the scholarship, and no claim for
8 repayment may be filed against the estate of such a decedent
9 or person under legal disability. Payments received by the
10 Commission under this subsection (d) shall be remitted to the
11 State Treasurer for deposit in the general revenue fund.
12 Each person receiving a scholarship shall be provided with a
13 description of the provisions of this subsection (d) at the
14 time he or she qualifies for the benefits of such a
15 scholarship.
16 (e) This Section is basically the same as Sections 30-1,
17 30-2, 30-3, and 30-4a of the School Code, which are repealed
18 by this amendatory Act of 1993, and shall be construed as a
19 continuation of the teacher scholarship program established
20 by that prior law, and not as a new or different teacher
21 scholarship program. The State Board of Education shall
22 transfer to the Commission, as the successor to the State
23 Board of Education for all purposes of administering and
24 implementing the provisions of this Section, all books,
25 accounts, records, papers, documents, contracts, agreements,
26 and pending business in any way relating to the teacher
27 scholarship program continued under this Section; and all
28 scholarships at any time awarded under that program by, and
29 all applications for any such scholarships at any time made
30 to, the State Board of Education shall be unaffected by the
31 transfer to the Commission of all responsibility for the
32 administration and implementation of the teacher scholarship
33 program continued under this Section. The State Board of
34 Education shall furnish to the Commission such other

1 information as the Commission may request to assist it in
2 administering this Section.

5 Sec. 65.40. General provisions; leaves of absence.
6 (a) The scholarships issued under Section 65.15 may be
7 used at the University of Illinois, Southern Illinois
8 University, Chicago State University, Eastern Illinois
9 University, Governors State University, Illinois State
10 University, Northeastern Illinois University, Northern
11 Illinois University, and Western Illinois University. Unless
12 otherwise indicated, the scholarships shall cover exempt the
13 holder from the payment of tuition and other necessary fees
14 as defined in Section 35 of this Act.
15 Any student who has been or shall be awarded a
16 scholarship shall be reimbursed by the appropriate university
17 or community college for any charges which he or she has paid
18 and for which exemption is granted under this Section, if
19 application for such reimbursement is made within 2 months
20 following the school term for which the charges were paid.
21 The holder of a scholarship shall be subject to all
22 examinations, rules and requirements of the university or
23 community college in which he or she is enrolled except as
24 herein directed.
25 This Section does not prohibit the Board of Trustees of
26 the University of Illinois, the Board of Trustees of Southern
27 Illinois University, the Board of Trustees of Chicago State
28 University, the Board of Trustees of Eastern Illinois
29 University, the Board of Trustees of Governors State
30 University, the Board of Trustees of Illinois State
31 University, the Board of Trustees of Northeastern Illinois
32 University, the Board of Trustees of Northern Illinois
33 University, and the Board of Trustees of Western Illinois

1 University for the institutions under their respective
2 jurisdictions from granting other scholarships.
3 (b) Any student enrolled in a university to which he or
4 she is holding a scholarship issued under Section 65.15 who
5 satisfies the president of the university or someone
6 designated by the president that the student requires leave
7 of absence for the purpose of earning funds to defray his or
8 her expenses while in attendance or on account of illness or
9 military service may be granted such leave and allowed a
10 period of not to exceed 6 years in which to complete his or
11 her course at the university. Time spent in the armed forces
12 shall not be part of the 6 years.
