093_SB0825 LRB093 02871 MKM 02887 b 1 AN ACT concerning guardianship and advocacy. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Guardianship and Advocacy Act is amended 5 by changing Section 2 as follows: 6 (20 ILCS 3955/2) (from Ch. 91 1/2, par. 702) 7 Sec. 2. Definitions. As used in this Act, unless the 8 context requires otherwise: 9 (a) "Authority" means a Human Rights Authority. 10 (b) "Commission" means the Guardianship and Advocacy 11 Commission. 12 (c) "Director" means the Director of the Guardianship 13 and Advocacy Commission. 14 (d) "Guardian" means a court appointed guardian or 15 conservator. 16 (e) "Services" includes but is not limited to 17 examination, diagnosis, evaluation, treatment, care, 18 training, psychotherapy, pharmaceuticals, after-care, 19 habilitation, and rehabilitation provided for an eligible 20 person. 21 (f) "Person" means an individual, corporation, 22 partnership, association, unincorporated organization, or a 23 government or any subdivision, agency, or instrumentality 24 thereof. 25 (g) "Eligible persons" means individuals who have 26 received, are receiving, have requested, or may be in need of 27 mental health services, or are "persons with a developmental 28 disability" as defined in the federal Developmental 29 Disabilities Services and Facilities Construction Act (Public 30 Law 94-103, Title II), as now or hereafter amended, or 31 "persons disabled" as defined in the Disabled Persons -2- LRB093 02871 MKM 02887 b 1 Rehabilitation Act. 2 (h) "Rights" includes but is not limited to all rights, 3 benefits, and privileges guaranteed by law, the Constitution 4 of the State of Illinois, and the Constitution of the United 5 States. 6 (i) "Legal Advocacy Service attorney" means an attorney 7 employed by or under contract with the Legal Advocacy 8 Service. 9 (j) "Service provider" means any public or private 10 facility, center, hospital, clinic, program, or any other 11 person devoted in whole or in part to providing services to 12 eligible persons. 13 (k) "State Guardian" means the Office of State Guardian. 14 (l) "Ward" means a ward as defined by the Probate Act of 15 1975, as now or hereafter amended, who is at least 18 years 16 of age. 17 (Source: P.A. 88-380; 89-626, eff. 8-9-96.)
