| AMENDMENT NO. ______. Amend Senate Bill 797, AS AMENDED, |

| with reference to page and line numbers of House Amendment No. |

| 1, on page 2, line 9 by inserting "3 days after" after "than"; |
| 5 |
| and
|
| 6 |
| on page 3, line 18 by inserting after the period the following: |
| 7 |
| "Procedures for notice, protest, and hearings shall be in |
| 8 |
| accordance with the Illinois Income Tax Act and the rules |
| 9 |
| adopted under that Act."; and
|
| 10 |
| on page 3, line 32 by inserting after the period the following: |
| 11 |
| "The Department shall adopt rules governing notice and protest |
| 12 |
| and establishing procedures for hearings in accordance with |
| 13 |
| Article 10 of the Illinois Administrative Procedure Act."; and
|
| 14 |
| on page 4, line 21 by replacing "a $1,000,000 reserve" with the |
| 15 |
| following: |
| 16 |
| "those moneys necessary for the Department to carry out its |
| 17 |
| powers and duties under this Act".
