1 AMENDMENT TO SENATE BILL 746
2 AMENDMENT NO. . Amend Senate Bill 746 by replacing
3 everything after the enacting clause with the following:
4 "Section 5. The University of Illinois Act is amended by
5 changing Section 7e-5 as follows:
6 (110 ILCS 305/7e-5)
7 Sec. 7e-5. In-state tuition charge.
8 (a) Notwithstanding any other provision of law to the
9 contrary, for tuition purposes, the Board of Trustees shall
10 deem an individual who is not a citizen or a permanent
11 resident of the United States an Illinois resident, until the
12 individual establishes a residence outside of this State, if
13 all of the following conditions are met:
14 (1) The individual resided with his or her parent
15 or guardian while attending a public or private high
16 school in this State.
17 (2) The individual graduated from a public or
18 private high school or received the equivalent of a high
19 school diploma in this State.
20 (3) The individual attended school in this State
21 for at least 3 years as of the date the individual
22 graduated from high school or received the equivalent of

1 a high school diploma.
2 (4) The individual registers as an entering student
3 in the University not earlier than the 2003 fall
4 semester.
5 (5) In the case of an individual who is not a
6 citizen or a permanent resident of the United States, The
7 individual provides the University with an affidavit
8 stating that the individual will file an application to
9 become a permanent resident of the United States at the
10 earliest opportunity the individual is eligible to do so.
11 (b) This Section applies only to tuition for a term or
12 semester that begins on or after the effective date of this
13 amendatory Act of the 93rd General Assembly. Any revenue lost
14 by the University in implementing this Section shall be
15 absorbed by the University Income Fund.

17 Section 10. The Southern Illinois University Management
18 Act is amended by changing Section 8d-5 as follows:
19 (110 ILCS 520/8d-5)
20 Sec. 8d-5. In-state tuition charge.
21 (a) Notwithstanding any other provision of law to the
22 contrary, for tuition purposes, the Board shall deem an
23 individual who is not a citizen or a permanent resident of
24 the United States an Illinois resident, until the individual
25 establishes a residence outside of this State, if all of the
26 following conditions are met:
27 (1) The individual resided with his or her parent
28 or guardian while attending a public or private high
29 school in this State.
30 (2) The individual graduated from a public or
31 private high school or received the equivalent of a high
32 school diploma in this State.

1 (3) The individual attended school in this State
2 for at least 3 years as of the date the individual
3 graduated from high school or received the equivalent of

11 contrary, for tuition purposes, a board shall deem an
12 individual who is not a citizen or a permanent resident of
13 the United States an Illinois resident, until the individual
14 establishes a residence outside of this State, if all of the
15 following conditions are met:
16 (1) The individual resided with his or her parent
17 or guardian while attending a public or private high
18 school in this State.
19 (2) The individual graduated from a public or
20 private high school or received the equivalent of a high
21 school diploma in this State.
22 (3) The individual attended school in this State
23 for at least 3 years as of the date the individual
24 graduated from high school or received the equivalent of
25 a high school diploma.
26 (4) The individual registers as an entering student
27 in the community college not earlier than the 2003 fall
28 semester.
29 (5) In the case of an individual who is not a

32 affidavit stating that the individual will file an

8 Section 99. Effective date. This Act takes effect upon
