 1        AN ACT in relation to executive agencies.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Arts Council Act is amended  by  changing
 5    Sections 1, 2, and 6 as follows:

 6        (20 ILCS 3915/1) (from Ch. 127, par. 214.11)
 7        Sec.  1.  Council created.  There is created the Illinois
 8    Arts Council, an agency of the State of Illinois.
 9        Until July 1, 2003 or when all of the new members  to  be
10    initially  appointed  under  this  amendatory Act of the 93rd
11    General  Assembly  have  been  appointed  by  the   Governor,
12    whichever  occurs  later,  the Illinois Arts Council shall be
13    composed of not less than 13 nor more than 35 members  to  be
14    appointed  by  the  Governor,  one  of whom shall be a senior
15    citizen age 60 or over.
16        The term of each appointed member of the Council  who  is
17    in  office  on  June 30, 2003 shall terminate at the close of
18    business on that date or when all of the new  members  to  be
19    initially  appointed  under  this  amendatory Act of the 93rd
20    General  Assembly  have  been  appointed  by  the   Governor,
21    whichever occurs later.
22        Beginning  on July 1, 2003 or when all of the new members
23    to be initially appointed under this amendatory  Act  of  the
24    93rd  General  Assembly  have been appointed by the Governor,
25    whichever occurs later, the Illinois Arts  Council  shall  be
26    composed  of  21 members to be appointed by the Governor, one
27    of whom shall be a senior citizen age 60 or over.
28        In  making  initial   appointments   pursuant   to   this
29    amendatory  Act  of  the  93rd General Assembly, the Governor
30    shall designate approximately  one-half  of  the  members  to
31    serve  for  2  years, and the balance of the members to serve

 1    for 4 years, each term of office to end on commence  July  1,
 2    1965.   The  senior citizen member first appointed under this
 3    amendatory Act of 1984 shall serve for  a  term  of  4  years
 4    commencing  July  1, 1985.  Thereafter all appointments shall
 5    be made for a 4 year term.  The Governor shall designate  the
 6    Chairman of the Council from among the members thereof.

 9        Sec. 2. Expenses.  No member may receive compensation for
10    his  services, but each member may be reimbursed for expenses
11    incurred in the performance of his duties.  A member  of  the
12    Council  who experiences a significant financial hardship due
13    to the loss of income on days of attendance  at  meetings  or
14    while otherwise engaged in the business of the Council may be
15    paid  a  hardship  allowance, as determined by and subject to
16    the approval of the Governor's Travel Control Board.

19        Sec. 6. Employees; operational services.
20        (a)  The Council may  employ  an  executive  director,  a
21    secretary,  and  such clerical, technical and other employees
22    and assistants as  it  considers  necessary  for  the  proper
23    transaction of its business.
24        (b)  The  Department of Central Management Services shall
25    provide to the Illinois Arts Council the same type and  level
26    of services as it provides to other State agencies, including
27    but  not  limited to office space, communications, facilities
28    management, and  any  other  operational  services  that  the
29    Department  provides  to other State offices and agencies, as
30    necessary to fulfill the Council's statutory mandate.

 1        Section 99.  Effective date.  This Act takes effect  upon
 2    becoming law.
