1 AN ACT concerning child care.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Child Care Act of 1969 is amended by
5 changing Section 18 as follows:
6 (225 ILCS 10/18) (from Ch. 23, par. 2228)
7 Sec. 18. Any person, group of persons, association, or
8 corporation who (1) conducts, operates, or acts as a child
9 care facility without a license or permit to do so in
10 violation of Section 3 of this Act before January 1, 2004
11 commits a Class A misdemeanor and on or after January 1, 2004
12 commits a Class 4 felony.;
13 Any person, group of persons, association, or corporation
14 who does any of the following is guilty of a Class A
15 misdemeanor:
16 (1) (blank);
17 (2) makes materially false statements in order to
18 obtain a license or permit;
19 (3) fails to keep the records and make the reports
20 provided under this Act;
21 (4) advertises any service not authorized by
22 license or permit held;
23 (5) publishes any advertisement in violation of
24 this Act;
25 (6) receives within this State any child in
26 violation of Section 16 of this Act; or
27 (7) violates any other provision of this Act or any
28 reasonable rule or regulation adopted and published by
29 the Department for the enforcement of the provisions of
30 this Act.
31 If an association or corporation is subject to a criminal

1 penalty for violation of this Act, is guilty of a Class A
2 misdemeanor and in case of an association or corporation,
3 imprisonment may be imposed upon its officers who knowingly
4 participated in the violation.
5 Any child care facility that continues to operate after
6 its license is revoked under Section 8 of this Act or after
7 its license expires and the Department refused to renew the
8 license as provided in Section 8 of this Act is guilty of a
9 business offense and shall be fined an amount in excess of
10 $500 but not exceeding $10,000, and each day of violation is
11 a separate offense.
12 In a prosecution under this Act, a defendant who relies
13 upon the relationship of any child to himself has the burden
14 of proof as to that relationship.
