 1        AN ACT in relation to health in the workplace.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Workers' Compensation Act is amended by
 5    changing Section 4a-1 as follows:

 6        (820 ILCS 305/4a-1) (from Ch. 48, par. 138.4a-1)
 7        Sec.   4a-1.  Self-Insurers    Advisory    Board.     The
 8    Self-Insurers Advisory Board is hereby established within the
 9    Commission  for the purpose of providing for the continuation
10    of workers' compensation and  occupational  disease  benefits
11    due  and  unpaid  or  interrupted  due to the inability of an
12    insolvent  self-insurer  as  defined  in  subsection  (d)  of
13    Section 4a-2 to meet its compensation  obligations  when  the
14    employers'  financial  resources,  security deposit, guaranty
15    agreements, surety agreements and excess insurance are either
16    inadequate or not immediately accessible for the  payment  of
17    benefits,  and to review and recommend to the Chairman of the
18    Commission  the  disposition  of  all  initial  and   renewal
19    applications  to  self-insure  filed by private self-insurers
20    under this Act and the Workers' Occupational Diseases Act.
