Amend Senate Bill 100 on page 1, by 3 inserting after line 1 the following: 4 "WHEREAS, The General Assembly finds that: 5 (a) Senate Joint Resolution 192 of the 86th General 6 Assembly was intended to provide for the payment of annual 7 cost-of-living adjustments as a component of the salary of 8 judges and other public officials to which it pertains; and 9 (b) Section 5 of Public Act 92-607, effective June 28, 10 2002, provides that judges, among others, shall not receive 11 any increase in compensation based on a cost-of-living 12 adjustment, as authorized by Senate Joint Resolution 192, for 13 or during the fiscal year beginning July 1, 2002; and 14 (c) Article VI, Section 14, of the Illinois Constitution 15 provides that "Judges shall receive salaries provided by law 16 which shall not be diminished to take effect during their 17 time of office"; and 18 (d) Section 5 of Public Act 92-607, as applied to 19 judges, in withholding payment of a component of judicial 20 compensation, does not comport with the provisions of Article 21 VI, Section 14, of the Illinois Constitution; and 22 (e) It is in the public interest to defer the next -2- LRB093 02843 JAM 12240 a 1 report of the Compensation Review Board that otherwise would 2 be filed in 2004 for an additional period of one year, 3 requiring the Board to file its next report in 2005 and to 4 file subsequent reports every 2 years; therefore"; and 5 on page 3, by inserting after line 14 the following: 6 "Notwithstanding the provisions of Public Act 92-607 or 7 any other law, the cost-of-living adjustment otherwise 8 authorized by Senate Joint Resolution 192 of the 86th General 9 Assembly for judges shall be deemed to have taken effect for 10 the fiscal year beginning July 1, 2002 and shall be 11 payable.".
