1 AMENDMENT TO SENATE BILL 20
2 AMENDMENT NO. . Amend Senate Bill 20 by replacing
3 the title with the following:
4 "AN ACT concerning renewable fuels."; and
5 by replacing everything after the enacting clause with the
6 following:
7 "Section 5. The Illinois Renewable Fuels Development
8 Program Act is amended by changing Sections 10 and 20 as
9 follows:

11 Sec. 10. Definitions. As used in this Act:
12 "Biodiesel" means a renewable diesel fuel derived from
13 biomass that is intended for use in diesel engines.
14 "Biodiesel blend" means a blend of biodiesel with
15 petroleum-based diesel fuel in which the resultant product
16 contains no less than 1% and no more than 99% biodiesel.
17 "Biomass" means non-fossil organic materials that have an
18 intrinsic chemical energy content. "Biomass" includes, but is
19 not limited to, soybean oil, other vegetable oils, and
20 ethanol.
21 "Department" means the Department of Commerce and

1 Community Affairs.
2 "Diesel fuel" means any product intended for use or
3 offered for sale as a fuel for engines in which the fuel is
4 injected into the combustion chamber and ignited by pressure
5 without electric spark.
6 "Director" means the Director of Commerce and Community
7 Affairs.
8 "Ethanol" means a product produced from agricultural
9 commodities or by-products used as a fuel or to be blended
10 with other fuels for use in motor vehicles.
11 "Fuel" means fuel as defined in Section 1.19 of the Motor
12 Fuel Tax Law.
13 "Gasohol" means motor fuel that is no more than 90%
14 gasoline and at least 10% denatured ethanol that contains no
15 more than 1.25% water by weight.
16 "Gasoline" means all products commonly or commercially
17 known or sold as gasoline (including casing head and
18 absorption or natural gasoline).
19 "Illinois agricultural product" means any agricultural
20 commodity grown in Illinois that is used by a production
21 facility to produce renewable fuel in Illinois, including,
22 but not limited to, corn, barley, and soy beans.
23 "Labor Organization" means any organization defined as a
24 "labor organization" under Section 2 of the National Labor
25 Relations Act (29 U.S.C. 152) means any organization:
26 (1) in which construction trades, crafts, or labor
27 employees, or all or any of these participate; and
28 (2) that represents construction trades, crafts, or
29 labor employees, or any or all of these; and
30 (3) that exists for the purpose, in whole or in
31 part, of negotiating with the employers of construction
32 trades, crafts, or labor employees, or any or all of
33 these, terms and conditions of employment, including but
34 not limited to: wages, hours of work, overtime

1 provisions, fringe benefits, and the settlement of
2 grievances; and
3 (4) that participates in apprenticeship and
4 training approved and registered with the United States
5 Department of Labor's Bureau of Apprenticeship and
6 Training, in the State of Illinois.
7 "Majority blended ethanol fuel" means motor fuel that
8 contains no less than 70% and no more than 90% denatured
9 ethanol and no less than 10% and no more than 30% gasoline.
10 "Motor vehicles" means motor vehicles as defined in the
11 Illinois Vehicle Code and watercraft propelled by an internal
12 combustion engine.
13 "Owner" means any individual, sole proprietorship,
14 limited partnership, co-partnership, joint venture,
15 corporation, cooperative, or other legal entity, including
16 its agents, that operates or will operate a plant located
17 within the State of Illinois.
18 "Plant" means a production facility that produces a
19 renewable fuel. "Plant" includes land, any building or other
20 improvement on or to land, and any personal properties deemed
21 necessary or suitable for use, whether or not now in
22 existence, in the processing of fuel from agricultural
23 commodities or by-products.
24 "Renewable fuel" means ethanol, gasohol, majority blended
25 ethanol fuel, biodiesel blend fuel, and biodiesel.

28 Sec. 20. Grants. Subject to appropriation from the Build
29 Illinois Bond Fund General Revenue Fund, the Director is
30 authorized to award grants to eligible applicants. The annual
31 aggregate amount of grants awarded shall not exceed
32 $15,000,000.

1 Section 99. Effective date. This Act takes effect upon
2 becoming law.".
