Amends the Illinois Vehicle Code. Provides that a pedestrian who is under the influence of intoxicating compounds (as well as one who is under the influence of alcohol or drugs), to a degree which renders the person a hazard, may not walk or be upon a highway except on a sidewalk. Provides that a violation is a Class C misdemeanor (rather than a petty offense). Provides that a person who violates the provision is guilty of a Class A misdemeanor if the violation is a proximate cause of an accident resulting in great bodily harm or death to another person.

| AN ACT concerning transportation.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Illinois Vehicle Code is amended by changing |
5 |
| Section 11-1010 as follows:
|

| Sec. 11-1010. Pedestrians under influence of alcohol or |

| drugs. |

| (a) A pedestrian who is under the influence of alcohol , |
10 |
| other
or any drug or drugs, intoxicating compound or compounds, |
11 |
| or any combination thereof, to a degree
which renders himself a |
12 |
| hazard shall not walk or be upon a highway except on
a |
13 |
| sidewalk. |

| (b) Except as provided in subsection (c), a violation of |
15 |
| this Section is a Class C misdemeanor. |
16 |
| (c) A person who, in violating this Section, is a proximate |
17 |
| cause of an accident causing great bodily harm or death to |
18 |
| another person, is guilty of a Class A misdemeanor.
