AMENDMENT TO HOUSE BILL 6902

2     AMENDMENT NO. ______. Amend House Bill 6902 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Criminal Code of 1961 is amended by
5 changing Section 11-19.1 as follows:
 
6     (720 ILCS 5/11-19.1)  (from Ch. 38, par. 11-19.1)
7     Sec. 11-19.1. Juvenile Pimping and aggravated juvenile
8 pimping.
9     (a) A person commits the offense of juvenile pimping if the
10 person knowingly receives anything of value derived from the
11 practice of prostitution, in whole or in part, and
12         (1) the prostitute was under the age of 16 at the time
13 the act of prostitution occurred; or
14         (2) the prostitute was a severely or profoundly
15 mentally retarded person at the time the act of
16 prostitution occurred Any person who receives any money,
17 property, token, object, or article or anything of value
18 from a prostitute under 16 years of age or from a
19 prostitute who is a severely or profoundly mentally
20 retarded person, not for a lawful consideration, knowing it
21 was earned in whole or in part from the practice of
22 prostitution, commits juvenile pimping.
23     (b) A person commits the offense of aggravated juvenile
24 pimping if the person knowingly receives anything of value

1 derived from the practice of prostitution, in whole or in part,
2 and the prostitute was under the age of 13 at the time the act
3 of prostitution occurred. It is an affirmative defense to a
4 charge of juvenile pimping that the accused reasonably believed
5 the person was of the age of 16 years or over or was not a
6 severely or profoundly mentally retarded person at the time of
7 the act giving rise to the charge.
8     (c) Sentence.
9     A person who commits a violation of subsection (a) is
10 guilty of Juvenile pimping is a Class 1 felony. A person who
11 commits a violation of subsection (b) is guilty of a Class X
12 felony.

14     Section 99. Effective date. This Act takes effect January
15 1, 2005.".
