Amends the Department of Public Health Powers and Duties Law of the
Civil Administrative Code of Illinois. Provides that the Department of Public Health, subject to appropriation, must conduct a study to determine the need and feasibility of creating a program to assist hospitals or other health care employers in operating a system by which nurses bid on work shifts by making an offer to work an available shift for a rate within a specified range posted by the employer. Requires the Department to report its findings to the Governor and to the General Assembly on or before July 1, 2005. Effective immediately.

| AN ACT concerning public health.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Department of Public Health Powers and |
5 |
| Duties Law of the
Civil Administrative Code of Illinois is |
6 |
| amended by adding Section 2310-223 as follows: |
7 |

| Sec. 2310-223. Nurse shift bidding study. The Department, |
9 |
| subject to appropriation, must conduct a study to determine the |
10 |
| need and feasibility of creating a program to assist hospitals |
11 |
| or other health care employers in operating a system by which |
12 |
| nurses bid on work shifts by making an offer to work an |
13 |
| available shift for a rate within a specified range posted by |
14 |
| the employer. The Department must consult with appropriate |
15 |
| medical and advocacy groups when conducting this study. The |
16 |
| Department may adopt any rules necessary to conduct this study |
17 |
| and must report its findings to the Governor and to the General |
18 |
| Assembly on or before July 1, 2005.

| Section 99. Effective date. This Act takes effect upon |
20 |
| becoming law.
