Amends the Consumer Fraud and Deceptive Business Practices Act.
Provides that, if a seller, manufacturer, distributor, or other person offers a rebate on the retail purchase of a product in this State, the rebate must be given to the consumer by the seller at the time the consumer purchases the product, in the form of a reduction of the selling price. Provides that a seller, manufacturer, distributor, or other person that offers a rebate on the retail purchase of a product in this State may not impose, as a condition of receiving the rebate, a requirement that the consumer submit, by mail or any other means, any proof of purchase, receipt, form, documentation, or other information or tangible thing after purchasing the product. Provides that a violation is an unlawful practice within the meaning of the Act.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Consumer Fraud and Deceptive Business |
5 |
| Practices Act is amended by adding Section 2QQ as follows: |

| (815 ILCS 505/2QQ new) |

| Sec. 2QQ. Rebates.
|

| (a) If a seller, manufacturer, distributor, or other person |
9 |
| offers a rebate on the retail purchase of a product in this |
10 |
| State, the rebate must be given to the consumer by the seller |
11 |
| at the time the consumer purchases the product, in the form of |
12 |
| a reduction of the selling price. A seller, manufacturer, |
13 |
| distributor, or other person that offers a rebate on the retail |
14 |
| purchase of a product in this State may not impose, as a |
15 |
| condition of receiving the rebate, a requirement that the |
16 |
| consumer submit, by mail or any other means, any proof of |
17 |
| purchase, receipt, form, documentation, or other information |
18 |
| or tangible thing after purchasing the product. |
19 |
| (b) A person who violates this Section commits an unlawful |
20 |
| practice within the meaning of this Act.
