SYNOPSIS AS INTRODUCED:

410 ILCS 620/3.21   from Ch. 56 1/2, par. 503.21

    Amends the Pharmacy Practice Act of 1987 and the Illinois Food, Drug and Cosmetics Act to allow pharmacists to initiate emergency contraception drug therapy without a prescription. Requires the pharmacist to provide the recipient of the emergency contraception drugs with a standardized fact sheet.

1     AN ACT concerning drugs.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Pharmacy Practice Act of 1987 is amended by
5 adding Section 22b as follows:
 
6     (225 ILCS 85/22b new)
7     Sec. 22b. Emergency contraception drug therapy. A
8 pharmacist may initiate emergency contraception drug therapy
9 without a prescription in accordance with standardized
10 procedures or protocols developed by the pharmacist and an
11 authorized prescriber who is acting within his or her scope of
12 practice. Prior to offering such drug therapy authorized under
13 this Section, a pharmacist shall have completed a training
14 program on emergency contraception, which includes, but is not
15 limited to, conduct of sensitive communications, quality
16 assurance, referral to additional services, and documentation.
17 For each emergency contraception drug therapy initiated
18 pursuant to this Section, the pharmacist shall provide the
19 recipient of the emergency contraception drugs with a
20 standardized fact sheet that includes, but is not limited to,
21 the indications for use of the drug, the appropriate method for
22 using the drug, the need for medical follow-up, and other
23 appropriate information. The Department shall develop this
24 form in consultation with the Department of Public Health, the
25 American College of Obstetricians and Gynecologists, the
26 Illinois Pharmacists Association, and other health care and
27 community organizations. The provisions of this Section do not
28 preclude the use of existing publications developed by
29 nationally recognized medical organizations.
 
30     Section 10. The Illinois Food, Drug and Cosmetic Act is
31 amended by changing Section 3.21 as follows:

2     Sec. 3.21. Except as authorized by this Act, the Controlled
3 Substances Act, the Pharmacy Practice Act of 1987, the Dental
4 Practice Act, the Medical Practice Act of 1987, the Veterinary
5 Medicine and Surgery Practice Act of 2004, or the Podiatric
6 Medical Practice Act of 1987, to sell or dispense a
7 prescription drug without a prescription.
8     Nothing in this Section shall be construed to prohibit a
9 pharmacist from initiating emergency contraception drug
10 therapy in accordance with Section 22b of the Pharmacy Practice
11 Act of 1987.
