Amends the Illinois Highway Code. Provides that any agency or instrumentality of the State of Illinois may seek recovery for the cost of the repair or replacement of damaged or destroyed roadway property, including road safety equipment and emergency equipment, and related emergency service charges. Provides that depreciation may not be used as a factor in determining the cost of the damaged or destroyed roadway property for which recovery is sought. Effective immediately.

| AN ACT concerning transportation.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Illinois Highway Code is amended by adding |
5 |
| Section 9-113.02 as follows: |
6 |
| (605 ILCS 5/9-113.02 new) |
7 |
| Sec. 9-113.02. Damage to State-owned roadway property. Any |
8 |
| agency or instrumentality of the State of Illinois may seek |
9 |
| recovery for the cost of the repair or replacement of damaged |
10 |
| or destroyed roadway property, including related emergency |
11 |
| service charges. As used in this Section, "roadway property" |
12 |
| includes road safety equipment and emergency equipment. |
13 |
| Depreciation may not be used as a factor in determining the |
14 |
| cost of the damaged or destroyed roadway property for which |
15 |
| recovery is sought.

| Section 99. Effective date. This Act takes effect upon |
17 |
| becoming law.
