1 | AMENDMENT TO HOUSE BILL 6423

2 | AMENDMENT NO. ______. Amend House Bill 6423 by replacing | ||||||
3 | the title with the following:
| ||||||
4 | "AN ACT concerning grand juries."; and | ||||||
5 | by replacing everything after the enacting clause with the | ||||||
6 | following:
| ||||||
7 | "Section 5. The Code of Criminal Procedure of 1963 is | ||||||
8 | amended by changing
Section 112-3 as follows:
| ||||||
9 | (725 ILCS 5/112-3) (from Ch. 38, par. 112-3)
| ||||||
10 | Sec. 112-3. Duration of Grand Jury.
| ||||||
11 | (a) In counties with a population in excess of 1,000,000 a | ||||||
12 | Grand Jury
shall be convened, impaneled and sworn, and shall | ||||||
13 | commence the performance
of its duties for an indeterminate | ||||||
14 | period, on the first Monday of each
month. In such counties a | ||||||
15 | Grand Jury shall serve until discharged by the
court, except | ||||||
16 | that no Grand Jury shall serve in excess of 18 months and not
| ||||||
17 | more than 6 Grand Juries shall sit at the same time.
| ||||||
18 | In counties with a population of
in excess of 225,000 but
| ||||||
19 | less than
1,000,000
a Grand Jury may be convened, empaneled, | ||||||
20 | and sworn and may sit at such times
and for such periods as the | ||||||
21 | circuit court may order on its own motion or that
of the | ||||||
22 | State's Attorney. No Grand Jury shall serve in excess of 18
| ||||||
23 | months and not more than 2 Grand Juries shall sit at the same |

| |||||||

2 | (b) (Blank).
In all other counties the Grand Jury shall be | ||||||
3 | called and
sit
at such
times and for such periods as the | ||||||
4 | circuit court may order on its own motion
or that of the | ||||||
5 | State's Attorney; provided, that no Grand Jury shall sit for
a | ||||||
6 | period in excess of 18 months and, provided further, that no | ||||||
7 | more than
one Grand Jury shall sit at the same time.

8 | (c) At any time for cause shown the court may excuse a | ||||||
9 | grand juror
either temporarily or permanently and, if | ||||||
10 | permanently, may impanel another
person in place of the grand | ||||||
11 | juror excused.
