AMENDMENT TO HOUSE BILL 6394

AMENDMENT NO. ______. Amend House Bill 6394 by replacing everything after the enacting clause with the following:

"Section 5. The Illinois Police Training Act is amended by adding Section 10.7 as follows:

(50 ILCS 705/10.7 new)

Sec. 10.7. Mandatory training; police chief and deputy police chief.

(a) Each police chief and deputy police chief shall obtain at least 20 hours of training each year. The training must be approved by the Illinois Law Enforcement Training and Standards Board and must be related to law enforcement, management or executive development, or ethics. This requirement may be satisfied by attending a conference held by an association that represents chiefs of police. Any police chief and any deputy police chief, upon presentation of a certificate of completion from the person or entity conducting the training, shall be reimbursed by the municipality for his or her reasonable expenses in obtaining the training required under this Section.

(b) Units of local government, including home rule units, may not regulate the training of police chiefs and deputy police chiefs in a manner less restrictive than the regulation by the State of the training of police chiefs and deputy police chiefs under this Section. This Section is a limitation under subsection (i) of Section 6 of Article VII of the Illinois Constitution on the concurrent exercise by home rule units of powers and functions exercised by the State.

Section 90. The State Mandates Act is amended by adding Section 8.28 as follows:

(30 ILCS 805/8.28 new)

Sec. 8.28. Exempt mandate. Notwithstanding Sections 6 and 8 of this Act, no reimbursement by the State is required for the implementation of any mandate created by this amendatory Act of the 93rd General Assembly.".
