| AN ACT in relation to child support.

| Be it enacted by the People of the State of Illinois, |
| 3 |
| represented in the General Assembly:
|

| Section 5. The Non-Support Punishment Act is amended by |
| 5 |
| changing
Section 10 as follows:
|

| (750 ILCS 16/10)
|

| Sec. 10. Proceedings. Proceedings under this Act may be by |
| 8 |
| indictment or
information. No proceeding may be brought under |
| 9 |
| Section 15
of this Act
against a person
whose court or |
| 10 |
| administrative order for support was entered by default, unless
|
| 11 |
| the indictment or information specifically alleges that the |
| 12 |
| person has
knowledge of the existence of the order for support |
| 13 |
| and that the person has the
ability to pay the support.
