    Amends the Developmental Disability and Mental Disability Services Act. Makes a technical change in a Section concerning an application and the amount of services to be provided.

1     AN ACT in relation to health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Developmental Disability and Mental
5 Disability Services Act is amended by changing Section 2-6 as
6 follows:
 
7     (405 ILCS 80/2-6)  (from Ch. 91 1/2, par. 1802-6)
8     Sec. 2-6. Application; amount of services. An application
9 for the Program shall be submitted to the Department by the
10 mentally disabled adult or, if the mentally disabled adult
11 requires a guardian, by his or her legal guardian. If the
12 application for participation in the Program is approved by the
13 Department and the mentally disabled adult is eligible to
14 receive services under this Article, the mentally disabled
15 adult shall be made aware of the availability of a community
16 support team and shall be offered case management services. The
17 amount of the home-based services provided by the Department in
18 any month shall be determined by the service plan of the
19 mentally disabled adult, but in no case shall it be more than
20 either:
21         (a) three hundred percent of the monthly federal
22     Supplemental Security Income payment for an individual
23     residing alone if the mentally disabled adult is not
24     enrolled in a special education program by a local
25     education agency, or
26         (b) two hundred percent of the monthly Supplemental
27     Security Income payment for an individual residing alone if
28     the mentally disabled adult is enrolled in a special
29     education program by a local education agency.
30     Upon approval of the Department, all or part of the monthly
31 amount approved for home-based services to participating
32 adults may be used as a one-time or continuing payment to the

1 eligible adult or the adult's parent or guardian to pay for
2 specified tangible items that are directly related to meeting
3 basic needs related to the person's mental disabilities.
4     Tangible items include, but are not limited to: adaptive
5 equipment, medication not covered by third-party payments,
6 nutritional supplements, and residential modifications.
