SYNOPSIS AS INTRODUCED:

    Amends the Illinois Vehicle Code and the State Finance Act. Creates the Choose Life Fund as a special fund in the State treasury. Provides for the issuance of special Choose Life license plates. Provides that the Secretary of State shall confer with Illinois Choose Life, Inc. of Illinois regarding the design, color, and format of the plates. Provides that, in addition to normal original issuance and renewal fees, a $25 fee shall be charged for the special plates. Provides that $10 of the additional initial fee and $23 of the additional renewal fee shall be deposited into the Choose Life Fund, and $15 of the additional original fee and $2 of the additional renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that, subject to appropriation by the General Assembly and approval by the Secretary of State, all moneys in the Choose Life Fund shall be distributed on a pro-rated basis at the beginning of each fiscal year to all non-governmental, not-for-profit agencies whose services include counseling and meeting the physical needs of pregnant women who are committed to placing their children for adoption. Establishes additional requirements for use of the moneys in the Fund. Effective immediately.

1     AN ACT concerning vehicles.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The State Finance Act is amended by adding
5 Section 5.625 as follows:
 
6     (30 ILCS 105/5.625 new)
7     Sec. 5.625. The Choose Life Fund.
 
8     Section 10. The Illinois Vehicle Code is amended by adding
9 Section 3-663 as follows:

11     Sec. 3-663. Choose Life license plates.
12     (a) The Secretary, upon receipt of an application made in
13 the form prescribed by the Secretary, may issue special
14 registration plates designated as Choose Life license plates to
15 any person who wishes to demonstrate support of organizations
16 that encourage adoption as a positive choice for women with
17 unplanned pregnancies. The special plates issued under this
18 Section shall be affixed only to passenger vehicles of the
19 first division and motor vehicles of the second division
20 weighing not more than 8,000 pounds. Plates issued under this
21 Section shall expire according to the multi-year procedure
22 established by Section 3-414.1 of this Code.
23     (b) The Secretary shall confer with Illinois Choose Life,
24 Inc. of Illinois regarding the design, color, and format of the
25 plates, which shall carry the words "Choose Life". The
26 Secretary may allow the plates to be issued as vanity plates or
27 personalized plates under Section 3-405.1 of this Code. The
28 Secretary shall prescribe stickers or decals as provided under
29 Section 3-412 of this Code.
30     (c) An applicant for the special plates shall be charged a

1 $25 fee for original issuance in addition to the appropriate
2 registration fee. Of this $25 fee, $10 shall be deposited into
3 the Choose Life Fund and $15 shall be deposited into the
4 Secretary of State Special License Plate Fund, to be used by
5 the Secretary to help defray the administrative processing
6 costs.
7     For each registration renewal period, a $25 fee, in
8 addition to the appropriate registration fee, shall be charged.
9 Of this $25 fee, $23 shall be deposited into the Choose Life
10 Fund and $2 shall be deposited into the Secretary of State
11 Special License Plate Fund.
12     (d) The Choose Life Fund is created as a special fund in
13 the State treasury. All moneys in the Choose Life Fund shall,
14 subject to appropriation by the General Assembly and approval
15 by the Secretary, be distributed on a pro-rated basis at the
16 beginning of each fiscal year to all non-governmental,
17 not-for-profit agencies whose services include counseling and
18 meeting the physical needs of pregnant women who are committed
19 to placing their children for adoption. No moneys may be
20 distributed to organizations described in subsection (f) of
21 this Section. Moneys shall be distributed in direct proportion
22 to the number of "Choose Life" registrations and renewals
23 attributable to each county. Any unused moneys in excess of 10%
24 of the moneys allocated to a non-profit organization shall be
25 returned to the Choose Life Fund at the end of the fiscal year
26 to be aggregated and distributed with the next fiscal year's
27 distributions.
28     (e) To apply for and receive moneys available through the
29 Choose Life Fund, an organization must deliver to the Secretary
30 an affidavit signed by a duly appointed representative of the
31 organization that states the following:
32         (1) The organization is a non-profit organization;
33         (2) The organization does not discriminate for any
34     reason, including but not limited to race, marital status,
35     gender, religion, national origin, handicap, or age;
36         (3) The organization is committed to counseling

1     pregnant women about the option of adoption;
2         (4) The organization is not involved or associated with
3     any abortion activities, including counseling for or
4     referrals to abortion clinics, providing medical
5     abortion-related procedures, or pro-abortion advertising;
6         (5) The organization does not charge women for any
7     services received;
8     (6) (i) The organization understands that no more than 60%
9     of the moneys received can be used for the material needs
10     of pregnant women who are committed to placing their
11     children for adoption, including clothing, housing,
12     medical care, food, utilities, and transportation. These
13     moneys may also be expended on infants awaiting placement
14     with adoptive parents.
15             (ii) Agencies that receive these moneys shall use
16         no more than 40% of the moneys received to enhance
17         their adoption efforts, including counseling,
18         training, or advertising;
19         (7) These moneys may not be used for administrative
20     expenses, legal expenses, or capital expenditures;
21         (8) The organization understands that any unused
22     moneys at the end of the fiscal year that exceed 10% of the
23     moneys received by the organization during the fiscal year
24     must be returned to the Choose Life Fund to be aggregated
25     and distributed with the next fiscal year's distribution;
26     and
27         (9) The organization understands that each
28     organization that receives moneys must submit to an annual
29     audit of those moneys verifying that the moneys received
30     were used in the manner described in this Section.
31     (f) Moneys in the Choose Life Fund may not be distributed
32 to any organization involved or associated with any abortion
33 activities, including counseling for or referrals to abortion
34 clinics, providing medical abortion-related procedures, or
35 pro-abortion advertising. Moneys may not be distributed to any
36 organization that charges women for services received.

1     (g) Sixty percent of the moneys received from the Choose
2 Life Fund can be used for the material needs of pregnant women
3 who are committed to placing their children for adoption,
4 including clothing, housing, medical care, food, utilities,
5 and transportation. These moneys may also be expended on

16     Section 99. Effective date. This Act takes effect upon
17 becoming law.
