1     AN ACT concerning sex offender management.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Sex Offender Management Board Act is amended
5 by changing Section 5 as follows:
 
6     (20 ILCS 4026/5)
7     Sec. 5. Legislative declaration. The General Assembly
8 hereby declares that the comprehensive evaluation,
9 identification, counseling, and continued monitoring of sex
10 offenders who are subject to the supervision of the criminal or
11 juvenile justice systems or mental health systems is necessary
12 in order to work toward the elimination of recidivism by such
13 offenders. Therefore, the General Assembly hereby creates a
14 program which standardizes the evaluation, identification,
15 counseling, and continued monitoring of sex offenders at each
16 stage of the criminal or juvenile justice systems or mental
17 health systems so that those offenders will curtail
18 recidivistic behavior and the protection of victims and
19 potential victims will be enhanced. The General Assembly
20 recognizes that some sex offenders cannot or will not respond
21 to counseling and that, in creating the program described in
22 this Act, the General Assembly does not intend to imply that
23 all sex offenders can be successful in counseling.
