| AN ACT in relation to environmental protection.
|

| Be it enacted by the People of the State of Illinois, |
3 |
| represented in the General Assembly:
|

| Section 5. The Environmental Protection Act is amended by |
5 |
| changing
Section 9.2 as follows:
|

| Sec. 9.2. Sulfur dioxide emission standards.

| (b) In granting any alternative emission standard or |
10 |
| variance relating
to sulfur dioxide emissions from a |
11 |
| coal-burning stationary source, the
Board may require the use |
12 |
| of Illinois coal as a condition of the
such
alternative |
13 |
| standard or variance, provided that the Board determines that
|
14 |
| Illinois coal of the proper quality is available and |
15 |
| competitive in price;
such determination shall include |
16 |
| consideration of the cost of pollution
control equipment and |
17 |
| the economic impact on the Illinois coal mining industry.
