| AN ACT concerning labor.
|

| Be it enacted by the People of the State of Illinois, |
3 |
| represented in the General Assembly:
|

| Section 5. The Employee Benefit Contribution Act is amended |
5 |
| by changing
Section 2 as follows:
|

| (820 ILCS 160/2) (from Ch. 48, par. 39x)

| Sec. 2. An
Any employer who has agreed to make payments to |
8 |
| an
employee
health insurance plan shall notify its employees of |
9 |
| any failure to make
such payments where such failure shall |
10 |
| result in the total
loss of insurance coverage
so as to provide |
11 |
| its employees a reasonable opportunity to replace such
coverage |
12 |
| at the time the employee health insurance plan terminates.
The |
13 |
| employer must provide written notification directly to each of |
14 |
| its
employees who
are covered under the plan. Any employer who |
15 |
| fails to provide timely notice of
a
prospective
termination of |
16 |
| a health insurance plan, which failure results in the
|
17 |
| deprivation
of the opportunity to replace such coverage and |
18 |
| which further results in
damages to one or more employees |
19 |
| arising from the loss of coverage,
shall be guilty of a Class B |
20 |
| misdemeanor.
