1     AN ACT concerning labor.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Employee Benefit Contribution Act is amended
5 by changing Section 2 as follows:
 
6     (820 ILCS 160/2)  (from Ch. 48, par. 39x)
7     Sec. 2. An Any employer who has agreed to make payments to
8 an employee health insurance plan shall notify its employees of
9 any failure to make such payments where such failure shall
10 result in the total loss of insurance coverage so as to provide
11 its employees a reasonable opportunity to replace such coverage
12 at the time the employee health insurance plan terminates. The
13 employer must provide written notification directly to each of
14 its employees who are covered under the plan. Any employer who
15 fails to provide timely notice of a prospective termination of
16 a health insurance plan, which failure results in the
17 deprivation of the opportunity to replace such coverage and
18 which further results in damages to one or more employees
19 arising from the loss of coverage, shall be guilty of a Class B
20 misdemeanor.
