| AN ACT in relation to criminal law.
|

| Be it enacted by the People of the State of Illinois, |
3 |
| represented in the General Assembly:
|

| Section 5. The Criminal Code of 1961 is amended by changing
|
5 |
| Section 19-2 as follows:
|

| (720 ILCS 5/19-2) (from Ch. 38, par. 19-2)

| Sec. 19-2.
Possession of burglary tools.
|

| (a) A person commits the offense of possession of burglary |
9 |
| tools when he
or she possesses any key, tool, instrument, |
10 |
| device, or any explosive,
suitable for
use in breaking into a |
11 |
| building, housetrailer, watercraft, aircraft, motor
vehicle as |
12 |
| defined in The Illinois Vehicle Code, railroad car, or any
|
13 |
| depository designed for the safekeeping of property, or any |
14 |
| part thereof,
with intent to enter any such place and with |
15 |
| intent to commit therein a
felony or theft.

| (b) Sentence.
|
17 |
| Possession of burglary tools in violation of this Section |
18 |
| is a Class 4
felony.
