Amends the Illinois Insurance Code. Provides that no policy of accident or health insurance or any renewal of such a policy may be cancelled by the insurer, nor may any such policy contain any exception or exclusion of benefits, solely because the insured is taking an experimental drug or an investigational drug. Effective immediately.

| AN ACT concerning insurance.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Illinois Insurance Code is amended by adding |
5 |
| Section 356o as follows: |

| (215 ILCS 5/356o new) |
7 |
| Sec. 356o. Cancellation of policy; experimental and |
8 |
| investigational drugs. No policy of accident or health |
9 |
| insurance or any renewal of such a policy may be cancelled by |
10 |
| the insurer, nor may any such policy contain any exception or |
11 |
| exclusion of benefits, solely because the insured is taking an |
12 |
| experimental drug or an investigational drug. |

| For the purposes of this Section, "experimental drug or |
14 |
| investigational drug" means any drug that the United States |
15 |
| Food and Drug Administration is reviewing, investigating, or |
16 |
| has not yet approved.

| Section 99. Effective date. This Act takes effect upon |
18 |
| becoming law.
