1 | AMENDMENT TO HOUSE BILL 5165

2 | AMENDMENT NO. ______. Amend House Bill 5165 by replacing | ||||||
3 | the title with the following: | ||||||
4 | "AN ACT in relation to governmental records."; and
| ||||||
5 | by replacing everything after the enacting clause withe the | ||||||
6 | following: | ||||||
7 | "Section 1. Short title. This Act may be cited as the | ||||||
8 | Social Security Number Protection Task Force Act. | ||||||
9 | Section 5. Findings. The General Assembly finds as follows: | ||||||
10 | (1) Identity theft is a major and growing problem in | ||||||
11 | the United States and in Illinois. | ||||||
12 | (2) An individual's social security number is a primary | ||||||
13 | means of identifying the individual, and the unauthorized | ||||||
14 | disclosure of the individual's social security number | ||||||
15 | creates a substantial risk that the individual's identity | ||||||
16 | may be stolen. | ||||||
17 | (3) Certain State officers and agencies require | ||||||
18 | individuals to disclose their social security numbers for | ||||||
19 | various reasons, thus creating the potential for the theft | ||||||
20 | of those individuals' identities if their social security | ||||||
21 | numbers are further disclosed without authorization. | ||||||
22 | (4) The State should take all necessary steps to ensure |

1 | that the procedures used by its officers and agencies do | ||||||
2 | not facilitate the theft of individuals' identities | ||||||
3 | through the unauthorized disclosure of those individuals' | ||||||
4 | social security numbers. | ||||||
5 | Section 10. Social Security Number Protection Task Force. | ||||||
6 | (a) The Social Security Number Protection Task Force is | ||||||
7 | created. The Task Force shall consist of the following members: | ||||||
8 | (1) One member representing the House of | ||||||
9 | Representatives, appointed by the Speaker of the House of | ||||||
10 | Representatives; | ||||||
11 | (2) One member representing the House of | ||||||
12 | Representatives, appointed by the Minority Leader of the | ||||||
13 | House of Representatives; | ||||||
14 | (3) One member representing the Senate, appointed by | ||||||
15 | the President of the Senate; | ||||||
16 | (4) One member representing the Senate, appointed by | ||||||
17 | the Minority Leader of the Senate; | ||||||
18 | (5) One member representing the Office of the Attorney | ||||||
19 | General, appointed by the Attorney General; | ||||||
20 | (6) One member representing the Office of the Secretary | ||||||
21 | of State, appointed by the Secretary of State; | ||||||
22 | (7) One member representing the Office of the Governor, | ||||||
23 | appointed by the Governor; | ||||||
24 | (8) One member representing the Department of Natural | ||||||
25 | Resources, appointed by the Director of Natural Resources; | ||||||
26 | (9) One member representing the Department of Public | ||||||
27 | Aid, appointed by the Director of Public Aid; | ||||||
28 | (10) One member representing the Department of | ||||||
29 | Revenue, appointed by the Director of Revenue; and | ||||||
30 | (11) One member representing the Department of State | ||||||
31 | Police, appointed by the Director of State Police.

32 | (b) The Task Force shall examine the procedures used by the | ||||||
33 | State to protect an individual against the unauthorized |

1 | disclosure of his or her social security number when the State | ||||||
2 | requires the individual to provide his or her social security | ||||||
3 | number to an officer or agency of the State. | ||||||
4 | (c) The Task Force shall report its findings and | ||||||
5 | recommendations to the Governor, the Attorney General, the | ||||||
6 | Secretary of State, and the General Assembly no later than the | ||||||
7 | first day of the 2004 fall veto session of the 93rd General | ||||||
8 | Assembly.

9 | Section 99. Effective date. This Act takes effect upon | ||||||
10 | becoming law.".
