SYNOPSIS AS INTRODUCED:
 
20 ILCS 105/4.15 new

    Amends the Illinois Act on the Aging. Requires the Department on Aging to develop and maintain an information system concerning the State's aging population and incapacitated and dependent adults and to prepare, publish, and disseminate related educational materials. Provides that the information system must be available for use by State and local agencies and by the public. Requires any public agency or private agency to submit information for the system upon request by the Department. Requires compliance with State and federal confidentiality laws and with federal information sharing standards.

1     AN ACT concerning information systems.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Act on the Aging is amended by
5 adding Section 4.15 as follows:
 
6     (20 ILCS 105/4.15 new)
7     Sec. 4.15. Information system; aging population and
8 incapacitated and dependent adults.
9     (a) The Department shall develop and maintain an
10 information system concerning the State's aging population and
11 incapacitated and dependent adults. The Department must
12 prepare, publish, and disseminate educational materials
13 concerning the information system and must continuously
14 develop objective devices and research methodologies for use
15 with the information system. To the fullest extent possible,
16 the Department must use existing sources of information to
17 develop and maintain the information system. The information
18 system must be available for use by the public, by State
19 agencies, by political subdivisions of the State, and by public
20 and private non-profit agencies. All State agencies and all
21 other public or private agencies must comply with requests from
22 the Department for information that is to be included in the
23 information system. In developing and maintaining the
24 information system, the Department must comply with State and
25 federal confidentiality laws. To the extent that it is
26 reasonable to do so, the information system must be compatible
27 with federal information sharing standards.
28     (b) The information system shall have the following
29 functions:
30         (1) To conduct research concerning the cause and nature
31     of problems related to the State's aging population and
32     incapacitated and dependent adults.

1         (2) To collect, maintain, and disseminate data and
2     statistics related to the State's aging population and
3     incapacitated and dependent adults.
4         (3) To determine, through a detailed survey, the extent
5     of problems related to the State's aging population and
6     incapacitated and dependent adults and the needs and
7     priorities for solving those problems throughout the
8     State.
9         (4) To maintain an inventory of the types and
10     quantities of both public and private facilities,
11     programs, and services provided for the State's aging
12     population and incapacitated and dependent adults,
13     including: (i) the unduplicated count, location, and
14     characteristics of individuals served by each facility,
15     program, or service and (ii) the source of resources
16     supporting functions related to the State's aging
17     population and incapacitated and dependent adults.
18         (5) To continuously evaluate: (i) the impact, quality,
19     and value of facilities, programs, and services provided
20     for the State's aging population and incapacitated and
21     dependent adults, including the administrative adequacy
22     and capacity of those facilities, programs, and services,
23     and (ii) programs operated for the State's aging population
24     and incapacitated and dependent adults by or with the
25     assistance of the State or the federal government,
26     including, but not limited to, activities related to
27     education, employment, vocational services, income,
28     health, housing, transportation, community services,
29     social services, rehabilitation services, protective
30     services, public guardianship or conservatorship,
31     supplemental social security, Medicare, Medicaid, property
32     tax refunds, and licensing standards for nursing,
33     intermediate care, and boarding facilities.
