1 | AN ACT concerning seniors.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Illinois Act on the Aging is amended by | ||||||
5 | adding Section 8.08 as follows: | ||||||
6 | (20 ILCS 105/8.08 new) | ||||||
7 | Sec. 8.08. Comprehensive Older Adults Services and Care | ||||||
8 | Planning Committee. | ||||||
9 | (a) The purpose of this Section is to promote cooperation | ||||||
10 | and consultation on the incremental redesign of Illinois' | ||||||
11 | long-term care system to provide services to older adults among | ||||||
12 | the Directors of Aging, Public Aid, and Public Health; | ||||||
13 | providers of care and services; and older adults and those who | ||||||
14 | advocate on their behalf. It is envisioned that the long-term | ||||||
15 | goal of this redesign will be the development, availability, | ||||||
16 | and accessibility of a comprehensive, affordable, and | ||||||
17 | sustainable long-term care system in Illinois. It is envisioned | ||||||
18 | that the redesign will encompass all aspects of the delivery of | ||||||
19 | services and care to older adults whether the services and care | ||||||
20 | are provided in the home, community, or a residential facility. | ||||||
21 | (b) The Comprehensive Older Adults Services and Care | ||||||
22 | Planning Committee is hereby created to advise the Directors of | ||||||
23 | Aging, Public Aid, and Public Health on all matters related to | ||||||
24 | the redesign of the long-term care system and the delivery of | ||||||
25 | services and care to older adults in general. | ||||||
26 | (c) The Committee shall be comprised of the following: | ||||||
27 | (1) The Director of Aging or his or her designee, who | ||||||
28 | shall serve as chair and shall be an ex officio and | ||||||
29 | nonvoting member. | ||||||
30 | (2) The Director of Public Aid and the Director of | ||||||
31 | Public Health or their designees, who shall serve as | ||||||
32 | vice-chairs and shall be ex officio and nonvoting members. |

1 | (3) One representative each of the Department of Public | ||||||
2 | Aid, the Department of Public Health, the Department of | ||||||
3 | Veterans Affairs, the Department of Human Services, the | ||||||
4 | Department of Insurance, the Department of Commerce and | ||||||
5 | Economic Affairs, the Department on Aging, the Office of | ||||||
6 | the State Ombudsman, and the Illinois Housing Finance | ||||||
7 | Authority, who shall be selected by their Director and | ||||||
8 | shall be ex officio and nonvoting members. | ||||||
9 | (4) Thirteen members appointed by the Director of Aging | ||||||
10 | in collaboration with the Directors of Public Health and | ||||||
11 | Public Aid as follows: | ||||||
12 | (A) one member selected from recommendations | ||||||
13 | submitted by organizations representing providers | ||||||
14 | funded under the Community Care Program pursuant to | ||||||
15 | this Act; | ||||||
16 | (B) one member selected from recommendations | ||||||
17 | submitted by organizations representing providers | ||||||
18 | funded under the federal Older Americans Act; | ||||||
19 | (C) one member selected from recommendations | ||||||
20 | submitted by organizations representing providers | ||||||
21 | funded by Title XVIII of the Social Security Act | ||||||
22 | (Medicare); | ||||||
23 | (D) one member selected from recommendations | ||||||
24 | submitted by organizations representing home and | ||||||
25 | community care providers funded only with general | ||||||
26 | revenue funds or other levied funds; | ||||||
27 | (E) one member selected from recommendations | ||||||
28 | submitted by organizations representing facilities | ||||||
29 | licensed under the Nursing Home Care Act; | ||||||
30 | (F) one member selected from recommendations | ||||||
31 | submitted by organizations representing establishments | ||||||
32 | licensed under the Assisted Living and Shared Housing | ||||||
33 | Act; | ||||||
34 | (G) one member selected from recommendations | ||||||
35 | submitted by organizations representing facilities | ||||||
36 | certified under the Supportive Living Facilities |

1 | Program (Section 5-5.01a of the Illinois Public Aid | ||||||
2 | Code); | ||||||
3 | (H) one member selected from recommendations | ||||||
4 | submitted by organizations representing community | ||||||
5 | based residential facilities; | ||||||
6 | (I) two members selected from recommendations | ||||||
7 | submitted by membership based statewide senior | ||||||
8 | advocacy groups, who do not receive state funds; | ||||||
9 | (J) one member with special expertise in | ||||||
10 | gerontology research or in health law; and | ||||||
11 | (K) two members who are Illinois residents over age | ||||||
12 | 65. | ||||||
13 | (d) In selecting voting members of the Committee, the | ||||||
14 | Directors shall attempt to ensure that the Committee includes | ||||||
15 | representation from urban and rural areas and different | ||||||
16 | geographical areas. No more than one voting member shall be | ||||||
17 | selected from the recommendations of any single organization | ||||||
18 | and no more than one voting member shall be employed by the | ||||||
19 | same agency, organization, association, or employer. | ||||||
20 | (e) Voting members of the Committee shall serve for a term | ||||||
21 | of 3 years or until a replacement is named. All members shall | ||||||
22 | be appointed no later than January 1, 2005. Of the initial | ||||||
23 | appointees, 4 members shall serve a term of one year; 4 shall | ||||||
24 | serve for a term of 2 years; and 5 shall serve for a term of 3 | ||||||
25 | years. A member's term does not expire until a successor is | ||||||
26 | appointed by the Director of Aging. Any member appointed to | ||||||
27 | fill a vacancy occurring prior to the expiration of the term | ||||||
28 | for which his or her predecessor was appointed shall be | ||||||
29 | appointed for the remainder of that term. The Committee shall | ||||||
30 | meet at least quarterly and more frequently at the call of the | ||||||
31 | Chair. A simple majority of those appointed shall constitute a | ||||||
32 | quorum. The affirmative vote of a majority of those present and | ||||||
33 | voting shall be necessary for committee action. Members of the | ||||||
34 | Committee shall receive no compensation for their services.
The | ||||||
35 | Director on Aging, in collaboration with the Directors of | ||||||
36 | Public Health and Public Aid, may form subcommittees comprised |

1 | of individuals recommended by advocacy groups, trade | ||||||
2 | associations, and other stakeholders. Subcommittee membership | ||||||
3 | is not limited to Committee members. Members of any | ||||||
4 | subcommittee formed under this Act shall receive no | ||||||
5 | compensation for their services. | ||||||
6 | (f) The Departments of Aging, Public Health, and Public Aid | ||||||
7 | shall cooperate with, seek the advice of, and collaborate with | ||||||
8 | the Committee on all matters relative to this Section. The | ||||||
9 | Department on Aging and the Departments of Public Health and | ||||||
10 | Public Aid shall enter into written inter-agency agreements to | ||||||
11 | implement this Section. The Department on Aging shall be the | ||||||
12 | lead agency, but the Departments of Public Health and Public | ||||||
13 | Aid shall assist in providing resources to support the work of | ||||||
14 | this Committee. | ||||||
15 | (g) The Departments shall issue a joint report to the | ||||||
16 | General Assembly on January 1 of each year on their progress | ||||||
17 | relative to this Section and the recommendations of the | ||||||
18 | Committee.

19 | Section 99. Effective date. This Act takes effect upon | ||||||
20 | becoming law.
