1 | AN ACT concerning radiation protection.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Radiation Protection Act of 1990 is amended | |||||||||||||||||||
5 | by changing Section 6 as follows:
| |||||||||||||||||||

7 | (Section scheduled to be repealed on January 1, 2011)

8 | Sec. 6. Accreditation of administrators of radiation; | |||||||||||||||||||
9 | Limited scope
accreditation; Rules and regulations; Education.
| |||||||||||||||||||
10 | (a) The Illinois Emergency Management Agency
Department | |||||||||||||||||||
11 | shall promulgate such rules and regulations as are
necessary to | |||||||||||||||||||
12 | establish accreditation standards and procedures, including a
| |||||||||||||||||||
13 | minimum course of education and continuing education | |||||||||||||||||||
14 | requirements in the
administration of radiation to human | |||||||||||||||||||
15 | beings, which are appropriate to the
classification of | |||||||||||||||||||
16 | accreditation and which are to be met by all physician
| |||||||||||||||||||
17 | assistants, advanced practice nurses, nurses,
technicians, or | |||||||||||||||||||
18 | other assistants who administer radiation to human beings
under | |||||||||||||||||||
19 | the supervision of a person licensed under the Medical Practice | |||||||||||||||||||
20 | Act
of 1987. Such rules and regulations may provide for | |||||||||||||||||||
21 | different classes of
accreditation based on evidence of | |||||||||||||||||||
22 | national certification, clinical
experience or community | |||||||||||||||||||
23 | hardship as conditions of initial and continuing
| |||||||||||||||||||
24 | accreditation. The rules and regulations of the Agency
| |||||||||||||||||||
25 | Department shall be
consistent with national standards in | |||||||||||||||||||
26 | regard to the protection of the
health and safety of the | |||||||||||||||||||
27 | general public.
| |||||||||||||||||||
28 | (b) The rules and regulations shall also provide that
| |||||||||||||||||||
29 | persons who have been accredited by the Agency
Department , in | |||||||||||||||||||
30 | accordance with the
Radiation Protection Act of 1990 , without | |||||||||||||||||||
31 | passing an examination, will remain
accredited as provided in | |||||||||||||||||||
32 | Section 43 of this Act and that those persons may
be |

1 | accredited, without passing an examination, to use other | ||||||
2 | equipment,
procedures, or supervision within the original | ||||||
3 | category of accreditation if
the Agency
Department receives | ||||||
4 | written assurances from a person licensed under the
Medical | ||||||
5 | Practice Act of 1987, that the person accredited has
the | ||||||
6 | necessary
skill and qualifications for such additional | ||||||
7 | equipment procedures or
supervision. The Department shall, in | ||||||
8 | accordance with subsection (c) of
this Section, provide for the | ||||||
9 | accreditation of nurses, technicians, or
other assistants, | ||||||
10 | unless exempted elsewhere in this Act, to perform a
limited | ||||||
11 | scope of diagnostic radiography procedures of the chest, the
| ||||||
12 | extremities, skull and sinuses, or the spine, while under the
| ||||||
13 | supervision of a person licensed under the Medical Practice Act | ||||||
14 | of 1987.
| ||||||
15 | (c) (Blank).
The rules or regulations promulgated by the | ||||||
16 | Department pursuant to
subsection (a) shall establish | ||||||
17 | standards and procedures for accrediting
persons to perform a | ||||||
18 | limited scope of diagnostic radiography procedures.
The rules | ||||||
19 | or regulations shall require persons seeking limited scope
| ||||||
20 | accreditation to register with the Department as a | ||||||
21 | "student-in-training,"
and declare those procedures in which | ||||||
22 | the student will be receiving
training. The | ||||||
23 | student-in-training registration shall be valid for a period
of | ||||||
24 | 16 months, during which the time the student may, under the | ||||||
25 | supervision
of a person licensed under the Medical Practice Act | ||||||
26 | of 1987, perform the
diagnostic radiography procedures listed | ||||||
27 | on the student's registration.
The student-in-training | ||||||
28 | registration shall be nonrenewable.
| ||||||
29 | Upon expiration of the 16 month training period, the | ||||||
30 | student shall be
prohibited from performing diagnostic | ||||||
31 | radiography procedures unless
accredited by the Department to | ||||||
32 | perform such procedures. In order to be
accredited to perform a | ||||||
33 | limited scope of diagnostic radiography procedures,
an | ||||||
34 | individual must pass an examination offered by the Department. | ||||||
35 | The
examination shall be consistent with national standards in | ||||||
36 | regard to
protection of public health and safety. The |

1 | examination shall consist of a
standardized component covering | ||||||
2 | general principles applicable to diagnostic
radiography | ||||||
3 | procedures and a clinical component specific to the types of
| ||||||
4 | procedures for which accreditation is being sought. The | ||||||
5 | Department may
assess a reasonable fee for such examinations to | ||||||
6 | cover the costs incurred
by the Department in conjunction with | ||||||
7 | offering the examinations.
| ||||||
8 | (d) The Agency
Department shall by rule or regulation | ||||||
9 | exempt from accreditation
physician assistants, advanced | ||||||
10 | practice nurses, nurses, technicians, or
other assistants who
| ||||||
11 | administer radiation to human
beings under supervision of a | ||||||
12 | person licensed to practice under the Medical
Practice Act of | ||||||
13 | 1987 when the services are performed on employees of a
business | ||||||
14 | at a medical facility owned and operated by the business. Such
| ||||||
15 | exemption shall only apply to the equipment, procedures and | ||||||
16 | supervision
specific to the medical facility owned and operated | ||||||
17 | by the business.

19 | Section 99. Effective date. This Act takes effect upon | ||||||
20 | becoming law.
